RECOMMENDATION: Staff recommends that the City Council accept completion of the project and authorize the City Cleric to file the Notice of Completion. BACKGROUND: The Lifeline Transportation Program (LTP) is a federal funded program that supports projects to benefit low-income connnunities. These projects are intended to address locally prioritized transportation gaps and barriers with new or expanded services, or improved transportation choices, which provide low- income communities a "lifeline" to access employment, services, and other activities that are considered essential to daily life. The Canal Street Pedestrian Access and Safety Improvements Project was designed based on the needs identified in the Canal neighborhood's Community Based Transportation Plan (CBTP) that was adopted in 2006 and constructed as part of the LTP. This project included the construction of bulb -out sidewalks, curb and gutter along with storm drain modifications along Canal Street from Larkspur Street to Portofino Street. On September 4, 2008, the City Council approved Resolution Number 12812 and authorized the Public Works Director to enter an agreement with Alta Planning and Design to design the project. On October 4, 2010 the City Council adopted the project plans and specifications that were advertised in accordance with San Rafael's Municipal code and policies on November 24, 2010. Bids were opened on December 15, 2010 at 10:30 AM. The City Council adopted Resolution Number 13085 authorizing the City Manager and City Clerk to enter into an agreement with Able General Engineering Inc. (the low bidder) and construction commenced on January 31, 2011. The engineer recommends acceptance of the project and recordation of a Notice of Completion. During the course of the construction many changes were necessary to account for existing umnarked underground utilities. Utilities, such as a large PG&E gas facility that could not be moved, were marked in one position but turned out to be in another position when the road was excavated. Our engineer's, working closely with our contractor, adapted the plan to develop a product that fits the intent of the program. This particular area of San Rafael also has issues with storm water pooling. Modification to the curb, gutter and drainage systems were necessary to reduce ponding. These changes were required for the project and could not have been anticipated prior to breaking ground with the construction. The original construction amount approved by City Council was $301,049.00. An additional $15,341.55 was necessary to complete the project which is supported within the original budget and no additional funding is necessary. ANALYSIS: Pursuant to Civil Code Section 3093 the City, owner of the improvements, is required to record a Notice of Completion upon acceptance of the improvements by the City. This acceptance initiates a time period during which project sub -contractors may file Stop Notices seeking payment from the City out of the funds owed to the Contractor for the project work. ACTION REQUIRED: Accept completion of the Canal Street Pedestrian Access and Safety Improvement Project, (Project #11122) and authorize the City Clerk to file a Notice of Completion.
