Meeting Date: July 18, 2011 SAN RAFAEL CITY COUNCIL AGENDA REPORT Department: Police Prepared by: Alan Piombo, Lieutenant City Manager Approval• Subject: RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING USE OF AND ACCEPTANCE OF FEDERAL JUSTICE ASSISTANCE GRANT FUNDS, IN PARTNERSHIP WITH THE COUNTY OF MARIN, IN THE AMOUNT OF $20,749.00 FOR INCREASED GANG ENFORCEMENT WITHIN THE CITY OF SAN RAFAEL AND THE UNINCORPORATED AREAS OF MARIN COUNTY. Recommendation: Staff recommends the Council adopt resolution authorizing the use of and accepts $20,749.00 for Gang Enforcement Operations. Background: Since 1994, the City of San Rafael Police Department has received Local Law Enforcement Block Grants (LLEBG) Funds for crime prevention, staffing costs and equipment procurement from the Department of Justice Bureau of Justice Assistance. The funds are determined by an amalgamation of population numbers with crime index figures. The funding has always required a 10% match by the City. The Bureau of Justice Assistance has consolidated the Local Law Enforcement Block Grant with the Edward Byrne Justice Assistance Grant and requires a new application process for the formula grant which includes Council approval of the application and acceptance of the award. The formula for determining the funding amount remains the same as above; however, the City is no longer required to match the funds. JAG allows the local agency with the flexibility to prioritize and place justice funds where they are needed most. The money is received at the beginning of the funding cycle and the agency is allowed to earn interest on the funds. The San Rafael Police Department will apply this allocation of funds under the Law Enforcement Programs Purpose Area to pay for increased gang enforcement within the City of San Rafael and the County of Marin. Analysis: The Justice Assistance Grant establishes a funding source for local agencies to support a broad range of activities to prevent and control crime based on FOR CITY CLERK ONLY File No.: Council Meeting: Disposition: SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 2 our own local needs and conditions. These funds cannot take the place of on-going or general fund budgeted items. This grant is in partnership with the County of Marin which was awarded $12,Q68.00 in this same grant. The funds must be used together on a joint project. The Marin County Sheriff's Office agreed that this money will be used to staff Police Officers and Deputy Sheriff's on overtime to increase gang enforcement efforts within San Rafael and unincorporated areas of Marin County. A Memorandum of Understanding will be written and agreed upon between the two agencies. Fiscal Impact: The Grant will be included in the non general fund revenue for the Police Department for FY 2011-12. The amount will be in addition to funds identified in services and supply line items in the operating budget Options: N/A Action Required: The City Council adopt the resolution authorizing the use of and acceptance of Justice Assistance Grant funds in the amount of $20,749.00 for increased gang enforcement within the City of San Rafael and the County of Marin. RESOLUTION NO. RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING USE OF AND ACCEPTANCE OF FEDERAL JUSTICE ASSISTANCE GRANT FUNDS IN THE AMOUNT OF $20,749.00 FOR INCREASED GANG ENFORCEMENT WITHIN THE CITY OF SAN RAFAEL AND THE UNINCORPORATED AREAS OF MARIN COUNTY. Whereas, the United States Department of Justice, Bureau of Justice Assistance granted the City of San Rafael $20,749.00 in Justice Assistance Grant (JAG) funds; and, Whereas, this block grant money may be spent to pay costs associated with increased gang enforcement within the City of San Rafael and the unincorporated areas of Marin County; and, Whereas, the Department will use those funds for increased gang enforcement within the City of San Rafael and, Whereas, the City Council must approve use of the grant funds to begin the process of grant approval; NOW, THEREFORE BE IT RESOLVED, that the City Council approves the use of and accepts $20,749.00 in Justice Assistance Grant funds.
