1. Minutes, February 12, 2013
Viktoriya Wise moved and Charlie Pick seconded to approve Minutes as presented. The vote is as
follows:
AYES: Larry Paul, Charlie Pick, Viktoriya Wise, Jack Robertson, Mark Lubamersky
NOES: None
ABSTAIN: Barrett Schaefer, Gerald Belletto
ABSENT: None
2. Appeal of the Zoning Administrator approval (November 14, 2012) of Use Permit (UP12-
022) for the operation of a licensed large family day care (9-14 children maximum) in a
two-story single family townhome; APN: 009-362-20; Planned Development (PD1562)
Zoning District; Heather Ludloff, owner; Leticia Arvizu, applicant; Victoria Pollick,
appellant; File No.: AP12-007. (Continued from February 12, 2013 and Public Hearing was
closed)
Barrett Schaefer recused himself from this item (due to a potential conflict of interest) and left the room.
New Planning Commissioner Gerald Belletto did not vote on this item as he was not present at the last
meeting where the item was heard.
Jack Robertson moved and Mark Lubamersky seconded to adopt resolution upholding appeal and
denying Zoning Administrator approval with the following modifications to the text of the resolution:
1) Create a new "Whereas" that states that Appeal points 2, 3 and 4 were found t o not be valid points.
2) Change the "Whereas" on Page 2 that refers to the Appeal points to only refer to Appeal point 1 and
then move the discussion of the end of the Appeal points under Appeal Point 1.
3) On Use Permit Finding #3 c) eliminate the words "on Baypoint Drive" so the item reads: c) the increase
in traffic and lack of parking would create a potential safety concern for both children attending the
daycare and cul-de-sac residents backing out of their driveways.
4) On Use Permit Finding #1, Subsection 3) to delete the words "outdoor recreational space" to read: 3)
noise from outdoor daycare activities would have an adverse impact on adjacent properties, which are in
close proximity to each other.
5) On Page 3, second "Whereas" should read Commissioner Wise, not Commission Wise.
The vote is as follows:
AYES: Larry Paul, Charlie Pick, Viktoriya Wise, Jack Robertson, Mark Lubamersky
NOES: None
ABSTAIN: Barrett Schaefer, Gerald Belletto
ABSENT: None
