SUBJECT: ACCEPT COMPLETION OF THE THIRD STREET AND UNION STREET
IMPROVEMENT PROJECT, PROJECT #11025, AND AUTHORIZE THE CITY CLERK TO
FILE THE NOTICE OF COMPLETION.
RECOMMENDATION:
Staff recommends that the City Council accept completion of the project and authorize the City Clerk to
file the Notice of Completion.
BACKGROUND:
As part of routine traffic monitoring, intersection analysis, signal inspection and response to requests from
citizens, staff analyzed the intersection of Third Street and Union Street for necessary improvements.
After the analysis, it was determined that the intersection was in need of improvements including
extension of the eastbound and westbound left turn pockets, installation of a new westbound right turn
pocket, various utility relocations, AC pavement dig out repairs, AC pavement overlay, drainage system
modifications, signing, striping and street lighting modifications, various ADA enhancements, installation
of landscaping and irrigation facilities and other corresponding work.
The City Council adopted Resolution numbers 11340, 12328 and 12731 authorizing the Public Works
Director to enter into and amend an agreement with Kimley-Horn & Associates, Inc. to design the above
mentioned intersection improvements. Design of the landscaping and irrigation system was completed by
City staff. Total cost of the design portion of the project totaled $146,976.05 which was completed in
March of 2009.
The City Council also adopted Resolution number 12723 dedicating 2,480 square feet of City owned
property to the public right of way, Resolution number 12764 authorizing the Public Works Director to
enter into an agreement with MMWD to relocate three fire hydrants and Resolution number 12730
authorizing the Public Works Director to enter into an agreement with Ghirardelli Associates order to
perform inspection services.
On March 16, 2009 City Council adopted the project plans and specifications which were advertised in
accordance with San Rafael's Municipal code and policies on March 20, 2009. Bids were opened on
April 15, 2009 at 2:30 PM. The City Council adopted Resolution number 12722 authorizing the Public
Works Director to enter into an agreement with Ghilotti Construction Company, Inc. (the low bidder) to

construct the project. After a 6 -week lead period to obtain the traffic signal materials construction
commenced on June 15th, 2009.
PROJECT UPDATE:
The project construction was completed on October 8`h, 2009 and the new facilities and improvements
were opened to the public. However, the project was fully completed on January 15`h, 2010 after
completion of some punch list items and utility coordination. The engineer recommends acceptance of
the project and recordation of a Notice of Completion.

On April 20, 2009 the City Council allocated $1,107,640.30 for the Third/Union Construction.
The total construction cost of the project fell below the allocated project amount.

The extension of working days was requested and approved for the scheduling of utility
inspection and approval.
ANALYSIS:
Pursuant to Civil Code Section 3093 the City, owner of the improvements, is required to record a
Notice of Completion upon acceptance of the improvements by the City. This acceptance
initiates a time period during which project sub contractors may file Stop Notices seeking
payment from the City out of the funds owed to the Contractor for the project work.
ACTION REQUIRED:
Accept completion of the Third Street and Union Street Improvement Project (Project #11025)
and authorize the City Clerk to file a Notice of Completion.
