SUBJECT: ACCEPT COMPLETION OF THE 5 FAIR DRIVE RETAINING WALL
REPLACEMENT PROJECT, PROJECT #11160, AND AUTHORIZE THE CITY CLERK TO FILE
THE NOTICE OF COMPLETION.
RECOMMENDATION:
Staff recommends that the City Council accept completion of the project and authorize the City Clerk to
file the Notice of Completion.
BACKGROUND:
On July 19, 2010 the City Council adopted the project plans and specifications which were advertised in
accordance with San Rafael's Municipal code and policies on January 22, 2010. Bids were opened on
August 31, 2010 at 10:30 AM. The City Council adopted Resolution number 13050 authorizing the
Public Works Director to enter into an agreement with Hillside Drilling, Inc. (the low bidder) to construct
the project.
PROJECT UPDATE:
The project construction was fully completed (including all punch list items) on November 24, 2010 and
the new facilities and improvements were opened to the public. The engineer recommends acceptance of
the project and recordation of a Notice of Completion.

Change Orders 1, 2, 3: After the start of construction a total of three changes were necessary to
complete the project. A concrete slab discovered under the surface was not shown on the plan.
Exceptionally hard drilling was encountered for some piles which were harder than the material
described on the original soils report for the project. In addition, the wall height was modified in
some areas to account for minor fluctuations in the ground surface. These changes comprised a
total of three change orders at a total additional cost to the contract of $5,709.19

All work was completed within the amount of working days specified.
ANALYSIS:
Pursuant to Civil Code Section 3093 the City, owner of the improvements, is required to record a
Notice of Completion upon acceptance of the improvements by the City. This acceptance
initiates a time period during which project sub contractors may file Stop Notices seeking
payment from the City out of the fiends owed to the Contractor for the project work.
ACTION REQUIRED:
Accept completion of the 5 Fair Drive Retaining Wall Replacement Project (Project #11160) and
authorize the City Clerk to file a Notice of Completion.
