HomeMy WebLinkAboutPW MTC Funding and Resolution of SupportAgenda Item No: 3.g Meeting Date: January 22, 2013 1 1 SAN RAFAEL CITY COUNCIL AGENDA REPORT Department: Public Works Prepared by: City Manager Approval: Director of Public Works File No.: 01.25.01 SUBJECT: ADOPT RESOLUTION OF LOCAL SUPPORT FOR METROPOLITAN TRANSPORTATION COMMISSION (MTC) DISCRETIONARY FUNDING AND AUTHORIZE THE FILING OF AN APPLICATION FOR FUNDING ASSIGNED TO MTC COMMITTING ANY NECESSARY MATCHING FUNDS AND STATING THE ASSURANCE TO COMPLETE THE PROJECT. RECOMMENDATION: Adopt resolution. BACKGROUND: The Metropolitan Transportation Commission (MTC) issued a call for grant applications for the One Bay Area Grant on September 20, 2012. As stated on MTC's website, the One Bay Area Grant Program (OBAG) establishes commitments and policies for investing approximately $800 million over a four-year cycle period (FYs 2012-13 through 2015-16), funded through continuations of the current surface transportation legislation currently known as SAFETEA (the Safe, Accountable, Flexible, Efficient Transportation Equity Act) or the new surface transportation authorization currently under congressional consideration. OBAG is a new funding approach that better integrates the region's federal transportation program with California's climate law (Senate Bill 375, Steinberg, 2008) and the Sustainable Communities Strategy. Funding distribution was to consider progress toward achieving local land -use and housing policies by: • Rewarding jurisdictions that accept housing allocations through the Regional Housing Need Allocation (RHNA) process and produce housing using transportation dollars as incentives. • Supporting the Sustainable Communities Strategy for the Bay Area by promoting transportation investments in Priority Development Areas (PDAs) and by initiating a pilot program that will support open space preservation in Priority Conservation Areas (PCA). • Providing a higher proportion of funding to local agencies and additional investment flexibility by eliminating required program investment targets. The OBAG program allows flexibility to invest in transportation categories such as Transportation for Livable Communities, bicycle and pedestrian improvements, local streets and roads preservation, and planning activities, while also FOR CITY CLERK ONLY File No.: Council Meeting: 's Disposition: IN SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 2 providing specific funding opportunities for Safe Routes to School (SR2S) and Priority Conservation Areas. The City of San Rafael applied for funding through the OBAG grant program for three projects: 1. Del Presidio Boulevard and Pt. San Pedro Road Resurfacing 2. Regional Transportation System Enhancements 3. Grand Avenue Pathway Connector Project Del Presidio Boulevard and Pt. San Pedro Road Resurfacing This project consists of resurfacing a section of Point San Pedro Road from 600 feet north of Biscayne Drive to the San Rafael Rock Quarry and resurfacing Del Presidio Boulevard from Manual T. Freitas Parkway to Las Galiinas Avenue. Work will include grinding of existing asphalt, installation of new asphalt concrete, adjustment of various utility covers, traffic signal loop replacement, installation of a new median, installation of pavement fabric, installation of roadway signs and roadway striping. Del Presidio Boulevard has an existing pavement condition index of 44 (out of 100). This roadway is classified as a minor arterial connecting Highway 101 to a major shopping center (Northgate Mall). An average of 14,700 vehicles travel upon this roadway each day. Point San Pedro Road between Biscayne Drive and the San Rafael Rock Quarry has an existing pavement condition index ranging from 24 to 60 (out of a possible 100). This roadway is classified as a minor arterial and approximately 5,000 vehicles travel upon it each day. Pt. San Pedro Road between the San Rafael Rock Quarry and the intersection of Third Street and Union Street is scheduled to be resurfaced as a joint project with the County of Marin within the next few years. The City requested $457,109 of OBAG funds for this project. On November 29, 2012, the Transportation Authority of Marin's (TAM) Board approved this project to receive OBAG funds for the full amount requested. Regional Transportation System Enhancements This regional congestion management project will prepare downtown San Rafael for upcoming rail operations. Improvements include upgrades to the existing traffic signal equipment and pedestrian facilities within a 1/4 mile radius of the Bettini Transit Center and the future rail station including: - Upgrades to signal equipment at 17 intersections to be rail compliant - Installation of count -down pedestrian signal heads at 13 signalized intersections - Installation of ADA compliant curb ramps - Widening of the sidewalk on Hetherton Street between 4th & 3rd and on 4th St between Hetherton & Tamalpais Currently, the City of San Rafael's traffic signal system is not equipped to work together with the future SMART rail system. The existing signal system was installed in the 1980s, is obsolete, and does not have the capability to coordinate with rail systems. Upgrading the majority of the system to include rail pre- emption is required for safety and to minimize impacts to regional vehicular congestion that will be experienced once the train is in operation. Installation of new, state-of-the-art equipment will allow coordination of the traffic signals with the rail signal system, reducing the traffic signal recovery time, and thereby reducing the impact to pedestrians, bicycles and vehicles travelling through these intersections. If the system is not coordinated with the future rail system, significant impacts to the 122,000 vehicles per day that travel upon these corridors will occur. In addition, those utilizing the Highway 101 on and off ramps would be impacted, as well as those travelling to and from the communities in western Marin County. The intersections within the project limits are closely spaced and SAN RAFAEL CITY COUNCIL AGENDA REPORT / Paye: 3 require coordination with various patterns and timings throughout the day. Coordination with the new train operations is essential to maintain a safe and efficient downtown system. The City requested $2,368,178 of OBAG funds for this project. On November 29, 2012, the TAM Board approved this project to receive $1,900,000 in OBAG funds. The Transportation Authority of Marin (TAM) has offered to Loan the City of San Rafael $500,000 utilizing the City's future Measure A funds. However, it is not recommended to utilize this loan as the Measure A funding is needed for the future repaving of many local streets and roads in the coming years. Instead, it is recommended to reduce the scope of the project, eliminating the sidewalk widening and curb ramp installations in order to complete the project within the amount of funds awarded. Staff will look for other sources of funding to supplement this project in the hopes that the sidewalk widening and curb ramps can be added back to the project and included for construction. Grand Avenue Pathway Connector Project This project will close a significant gap in the City's bicycle and pedestrian network by installing a new 12 foot wide, 150 foot long bridge across the San Rafael Canal on the east side of Grand Avenue for use by bicyclists and pedestrians. Improvements also include widening the sidewalk north of the proposed bridge and upgrades to the southeast corner of the intersection of Second St. and Grand Ave. to provide a safe crossing for bicyclists. This project will provide access from the Canal neighborhood to the Bettini Transit Center, the future SMART rail station, Montecito Shopping Center, San Rafael High School and San Rafael's downtown business district. This route is one of only two access points to the Canal neighborhood, San Rafael's most densely populated area, and is heavily used by bicyclists and pedestrians. The City requested $1,624,526 of OBAG funds for this project. This project was not selected by the TAM Board to receive any OBAG funding. ANALYSIS: A resolution of local support is required in order to be eligible to receive funding through the OBAG program. FISCAL IMPACT: Two City of San Rafael projects have been awarded a total of $2,357,000 of federal funding; $457,000 for the Del Presidio Bouelard and Pt. San Pedro Road Resurfacing project and $1,900,000 for the Regional Transportation System Enhancements Project through the OBAG program. For each project an 11.47% City Match ($270,34790) is required. The total project budgets will therefore be: - Del Presidio Boulevard and Pt. San Pedro Road Resurfacing: $509,418 - Regional Transportation System Enhancements: $2,117,930 Based on final cost estimates, additional funding may be added to each project from other local funding sources such as Gas Tax and Measure A. These sources and amounts will be determined at a later date. ACTION REQUIRED: Adopt Resolution Enclosures (1) 1. Resolution RESOLUTION NO 13482 A RESOLUTION OF LOCAL SUPPORT FOR MTC DISCRETIONARY FUNDING AND AUTHORIZING THE FILING OF AN APPLICATION FOR FUNDING ASSIGNED TO THE METROPOLITAN TRANSPORTATION COMMISSION (MTC) COMMITTING ANY NECESSARY MATCHING FUNDS AND STATING THE ASSURANCE TO COMPLETE THE PROJECT WHEREAS, The City of San Rafael (herein referred to as APPLICANT) is submitting an application to the Metropolitan Transportation Commission (MTC) for $2,357,000 in funding assigned to MTC for programming discretion, including but not limited to federal funding administered by the Federal Highway Administration (FHWA) such as Surface Transportation Program (STP) funding, Congestion Mitigation and Air Quality Improvement (CMAQ) funding and/or Transportation Alternatives (TA) funding (herein collectively referred to as REGIONAL DISCRETIONARY FUNDING) for the 'Del Presidio Boulevard and Pt. San Pedro Road Resurfacing' project and the `Regional Transportation System Enhancements' project (herein collectively referred to as PROJECT) for the One Bay Area Grant Program (herein referred to as PROGRAM); and WHEREAS, the Moving Ahead for Progress in the 21st Century Act (Public Law 112-141, July 6, 2012) and any extensions or successor legislation for continued funding (collectively, MAP 21) authorize various federal funding programs including, but not limited to the Surface Transportation Program (STP) (23 U.S.C. § 133), the Congestion Mitigation and Air Quality Improvement Program (CMAQ) (23 U.S.C. § 149) and the Transportation Alternatives Program (TA) (23 U.S.C. § 213); and WHEREAS, state statutes, including California Streets and Highways Code 182.6 and 182.7 provide various funding programs for the programming discretion of the Metropolitan Planning Organization (MPO) and the Regional Transportation Planning Agency (RTPA); and WHEREAS, pursuant to MAP -21, and any regulations promulgated thereunder, eligible project sponsors wishing to receive federal funds for a project shall submit an application first with the appropriate MPO for review and inclusion in the MPO's Transportation Improvement Program (TIP); and WHEREAS, MTC is the MPO and RTPA for the nine counties of the San Francisco Bay region; and WHEREAS, MTC has adopted a Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised) that sets out procedures governing the application and use of federal funds; and WHEREAS, APPLICANT is an eligible sponsor for REGIONAL DISCRETIONARY FUNDING; and WHEREAS, as part of the application for REGIONAL DISCRETIONARY FUNDING, MTC requires a resolution adopted by the responsible implementing agency stating the following: 1. the commitment of any required matching funds; and 2. that the sponsor understands that the REGIONAL DISCRETIONARY FUNDING is fixed at the programmed amount, and therefore any cost increase cannot be expected to be funded with additional REGIONAL DISCRETIONARY FUNDING; and 3. that the project will comply with the procedures, delivery milestones and funding deadlines specified in the Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised); and 4. the assurance of the sponsor to complete the project as described in the application, and if approved, as included in MTC's federal Transportation Improvement Program (TIP); and 5. that the project will comply with all project -specific requirements as set forth in the PROGRAM; and 6. that the project (transit only) will comply with MTC Resolution No. 3866, revised, which sets forth the requirements of MTC's Transit Coordination Implementation Plan to more efficiently deliver transit projects in the region. NOW, THEREFORE, BE IT RESOLVED that the APPLICANT is authorized to execute and file an application for funding for the PROJECT for REGIONAL DISCRETIONARY FUNDING under MAP -21 for continued funding; and BE IT FURTHER RESOLVED that the APPLICANT by adopting this resolution does hereby state that: 1. APPLICANT will provide any required matching funds; and 2. APPLICANT understands that the REGIONAL DISCRETIONARY FUNDING for the project is fixed at the MTC approved programmed amount, and that any cost increases must be funded by the APPLICANT from other funds, and that APPLICANT does not expect any cost increases to be funded with additional REGIONAL DISCRETIONARY FUNDING; and 3. APPLICANT understands the funding deadlines associated with these funds and will comply with the provisions and requirements of the Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised) and APPLICANT has, and will retain the expertise, knowledge and resources necessary to deliver federally -funded transportation projects, and has assigned, and will maintain a single point of contact for all FNWA-funded transportation projects to coordinate within the agency and with the respective Congestion Management Agency (CMA), MTC, Caltrans and FNWA on all communications, inquires or issues that may arise during the federal programming and delivery process for all FNWA-funded transportation projects implemented by APPLICANT; and 4. PROJECT will be implemented as described in the complete application and in this resolution and, if approved, for the amount approved by MTC and programmed in the federal TIP; and 5. APPLICANT and the PROJECT will comply with the requirements as set forth in MTC programming guidelines and project selection procedures for the PROGRAM; and 6. APPLICANT (for a transit project only) agrees to comply with the requirements of MTC's Transit Coordination Implementation Plan as set forth in MTC Resolution 3866, revised; and therefore be it further BE IT FURTHER RESOLVED that APPLICANT is an eligible sponsor of REGIONAL DISCRETIONARY FUNDING funded projects; and BE IT FURTHER RESOLVED that APPLICANT is authorized to submit an application for REGIONAL DISCRETIONARY FUNDING for the PROJECT; and BE IT FURTHER RESOLVED that there is no legal impediment to APPLICANT making applications for the funds; and BE IT FURTHER RESOLVED that there is no pending or threatened litigation that might in any way adversely affect the proposed PROJECT, or the ability of APPLICANT to deliver such PROJECT; and BE IT FURTHER RESOLVED that APPLICANT authorizes the Public Works Director to execute and file an application with MTC for REGIONAL DISCRETIONARY FUNDING for the PROJECT as referenced in this resolution; and BE IT FURTHER RESOLVED that a copy of this resolution will be transmitted to the MTC in conjunction with the filing of the application; and BE IT FURTHER RESOLVED that the MTC is requested to support the application for the PROJECT described in the resolution and to include the PROJECT, if approved, in NITC's federal TIP. 1, ESTHER C.
