BACKGROUND: San Rafael Police Department's fleet of "black and white" patrol vehicles consists of 12 active and 4 reserve units. On November 20, 2012 unit #228, a 2009 Ford Crown Victoria, was sideswiped while traveling northbound on Highway 101 north of the Central San Rafael exit. The patrol car was damaged extensively and subsequently deemed "totaled" by insurance examiners. SRPD's patrol structure depends heavily upon an adequate number of vehicles. There are a minimum of 5 and a maximum of 11 units on San Rafael's streets during any 10 to 12 hour shift, depending upon the time of day and need. One officer is assigned to each patrol unit. Removing a single vehicle from the fleet, even temporarily, impacts the department's ability to respond to emergency calls and their inherently disproportionate impact on limited resources. AiNALYSIS: The Police Department has utilized California State Contract Pricing to purchase public safety vehicles for many years, in accordance with the Chapter 2.55.260 (Cooperative Purchasing Programs) of the San Rafael Municipal Code: "Purchases of supplies, material, equipment or services and sales of surplus property made under a cooperative purchasing program, utilizing purchasing agreements maintained by the state, county or other public agencies are exempt from the requirements of this chapter. To the extent possible, cooperative purchases joined will be competitively awarded, and documentation as to the advantage of the cooperative purchase will be retained." San Rafael purchases police vehicles through Folsom Lake Ford, under the State Contract Pricing program described above. With Council's approval, they will hold one for the SRPD, thereby shortening a delivery timeline that can stretch to 4 months. FISCAL IMPACT: The California State Contract price for a Ford Pursuit Sedan is $23,993.11. Outfitting the vehicle with the additional equipment needed for police use will cost $15,621.22, for a total price of $39,614.33 ($23,993.11 + $15,621.22 = $39,614.33). Revenue from the insurance settlement and auction, yet to be determined as of this writing, will offset the purchase price and will be assigned to the Vehicle Replacement Fund. There are sufficient resources in the City's Vehicle Replacement Fund to pay for the vehicle and the required additional equipment. OPTIONS: Council may choose not to approve the resolution, but staff does not recommend this option. Replacement of this unit will bring the PD's black and white fleet back to full strength. In addition, San Rafael will save a significant amount of money by purchasing through the California State Contract Pricing program. For these reasons, staff recommends that Council approve the resolution. ACTION REQUIRED: Adopt resolution. THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: WHEREAS, Police Department patrol vehicle #228-09 was totaled on November 20, 2012, effectively reducing the department's patrol fleet of 12 active and 4 reserve vehicles; and WHEREAS, the absence of this vehicle has a direct bearing on patrol operations and potentially impacts the department's ability to respond to emergency and non -emergency calls for service; and WHEREAS, Chapter 2.55.260 (Cooperative Purchasing Programs) of the San Rafael Municipal Code provides for the "Purchases of supplies, material, equipment or services and sales of surplus property made under a cooperative purchasing program, utilizing purchasing agreements maintained by the state, county or other public agencies are exempt from the requirements of this chapter. To the extent possible, cooperative purchases joined will be competitively awarded, and documentation as to the advantage of the cooperative purchase will be retained"; and WHEREAS, the Police Department has utilized California State Contract Pricing, an example of the cooperative purchasing program described in the above -referenced chapter, to purchase vehicles for many years; and WHEREAS, there are sufficient funds in the City's Vehicle Replacement Fund to purchase this vehicle. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Rafael, that the Council authorizes the Department of Public Works to purchase one Ford Interceptor sedan to replace Police Department patrol unit #228-09, in an amount not to exceed $39,614.33. 1, ESTHER C.
