RECOMMENDATION: Staff recommends that the City Council accept completion of the project and authorize the City Clerk to file the Notice of Completion. BACKGROUND: The Non -Motorized Transportation Pilot Program (NTPP), funded through federal transportation legislation in 2005 (SAFETEA-LU), allocated $25 million to four communities nationwide including Marin County. The pilot program was initiated locally in the summer of 2006 by the Marin County Department of Public Works. The Mahon Creek Path to Transit Center Connector Project is one of 50 NTPP projects, chosen out of over 200, to be implemented in Marin County. The design team developed improvement alternatives which were presented to stakeholders, including the San Rafael Bicycle and Pedestrian Advisory Committee (BPAQ, the San Rafael Americans with Disabilities Act (ADA) Committee, and the Marin County Bicycle Coalition (MCBC). The proposed improvements include construction of ADA compliant curb ramps and installation of roadside signage. The design of the project was completed by Alta Planning and Design, Inc. On January 22, 2013, the City Council adopted the plans and specifications and authorized the City Clerk to call for bids. The project was advertised in accordance with San Rafael's Municipal Code and policies on January 25, 2013, and sealed bids were publicly opened and read aloud on February 21, 2013 at 10:15 AM. On March 4, 2013, the City Council adopted Resolution No. 13504 authorizing the Public Works Director to enter into an agreement with the low bidder, West Bay Builders, and construction commenced on April 17, 2013. Construction was completed on May 9, 2013 within the originally authorized construction budget and timeline. The total project cost, including design, bidding, and construction is $130,099.21 as shown below. We recommend acceptance of the project and recordation of the Notice of Completion. ANALYSIS: Pursuant to Civil Code Section 3093 the City is required to record a Notice of Completion upon acceptance of the improvements by the City. This acceptance Initiates a time period during which project subcontractors may file Stop Notices seeking payment from the City out of the funds owed to the Contractor for the project work. FISCAL IMPACT: This project is fully funded through the Federal Non -Motorized Transportation Pilot Program (NTPP) and no local match is required with the grant. Staff is currently working on reimbursement through the California Department of Transportation Local Assistance branch.
