SUBJECT: Point San Pedro Road Median Landscaping Assessment District
RECOMMENDATION: Staff recommends the following actions:
1. Adopt Resolution Directing Filing of Engineer's Annual Report 2013/2014
2. Adopt Resolution Approving Engineer's Annual Report 2013/2014
3. Adopt Resolution of Intention to Order Improvements and Setting Public Hearing on
Annual Assessment for City Council Meeting of July 15, 2013.
BACKGROUND:
The Point San Pedro Road Median Landscaping Assessment District was formed to generate
revenue to reconstruct, repair and maintain the 29 median islands along Point San Pedro Road,
from Union St. to Biscayne Drive. These medians are located within the City limits of San
Rafael and the immediate contiguous unincorporated area of the County of Marin. Existing
plants and irrigation infrastructure had deteriorated over time. Due to a lack of capital project
funds and significant staff cutbacks, the City and County had limited median maintenance to
little more than trimming to control overgrowth.
As a result many properties owners in close proximity to Point San Pedro Road undertook an
effort to form an assessment district to fund the capital costs associated with construction and
restoration of the landscaping as well as ongoing maintenance and operation of those
improvements. Ultimately, in 2011, the City Council initiated proceedings and declared their
intention to establish a special benefit assessment district pursuant to the provisions of the
Landscape and Lighting Act of 1972. The City conducted a property owner ballot for the
proposed District assessments and held a noticed public hearing on June 20, 2011 to consider
testimony regarding the formation of the District and the levy of assessments. On June 22, 2011
the City Council confirmed the results of that ballot, with 61.39% of the ballots in favor of the
assessments and 38.61010 opposed. June 22, 2011 the City Council approved and adopted the

formation of the District and ordered the levy and collection of assessments for fiscal year
2011/2012, the first year's annual assessments.
ANALYSIS:
In order to comply with provisions of the Landscaping and Lighting Act, the City Council must
take certain actions on an annual basis. Assessments collected by the District must be allocated
annually after an appropriate public hearing, to be held this year on July 15, 2013.
FISCAL IMPACT:
The Annual Assessment Rate for a typical single-family dwelling located in the Assessment
District will be $79.50, subject to future adjustments for inflation: $53.60 for bond debt service
for capital improvements plus $25.90 for ongoing maintenance of landscaping and irrigation
infrastructure. By comparison, the FY 2013-2014 assessment of $79.50 was 3% higher than the
FY 2012-2013 assessment of $77.25, consistent with the inflation factor built into the process.
The revenues generated by levying Assessment District property owners have paid for the "Pt.
San Pedro Medians Landscaping Improvement" capital project, which totaled $1,682,065. That
figure includes expenditures for design, construction and construction management. Annual
maintenance of Assessment District improvements is estimated to cost $79,260.

RESOLUTION DIRECTING FILING OF ENGINEER'S ANNUAL
REPORT 2013/2014
POINT SAN PEDRO ROAD MEDIAN LANDSCAPING ASSESSMENT DISTRICT
(Pursuant to the Landscaping and Lighting Act of 1972)
The City Council of the City of San Rafael resolves:
1. Willdan Financial Services is designated by this Council as the Engineer
of Work for Point San Pedro Road Median Landscaping Assessment District, City of San
Rafael, Marin County, California, and is hereby directed to file an annual report for fiscal
year 2013-2014 in accordance with the provisions of the Landscaping and Lighting Act of
1972.
2. This resolution is adopted pursuant to Section 22622 of the Streets and
Highways Code.

The City Council of the City of San Rafael resolves:
1. Willdan Financial Services, as designated Engineer of Work for Point
San Pedro Road Median Landscaping Assessment District, has filed with the City Clerk an
Engineer's Annual Report for fiscal year 2013-2014 in accordance with the provisions of
the Landscaping and Lighting Act of 1972.
2. The aforementioned Engineer's Annual Report, on file with the City
Clerk, is approved as filed.

RESOLUTION OF INTENTION TO ORDER IMPROVEMENTS AND
SETTING PUBLIC HEARING ON ANNUAL ASSESSMENT FOR CITY
COUNCIL MEETING ON JULY 15, 2013

(Pursuant to the Landscaping and Lighting Act of 1972)
The City Council of the City of San Rafael resolves:
1. The City Council intends to levy and collect assessments within Point
San Pedro Road Median Landscaping Assessment District, City of San Rafael, Marin
County, California, during the fiscal year 2013-2014. The area of land to be assessed is
located in the City of San Rafael, Marin County.
2. In accordance with this Council's resolution directing the filing of an
Engineer's Annual Report Willdan Financial Services, Engineer of Work, has filed with the City
Clerk the report required by the Landscaping and Lighting Act of 1972. All interested persons
are referred to that report for a full and detailed description of the improvements, the boundaries
of the assessment district and the proposed assessments upon assessable lots and parcels of land
within the assessment district.
