HomeMy WebLinkAboutED REST Program Fee Waiver 2013CITY OF 409 ANN Agenda Item No: 3, f Meeting Date: September 16, 2013 SAN RAFAEL CITY COUNCIL AGENDA REPORT - Department: Economic Development i *P-41�KA� Prepared by: Stephanie Lovette, Manager Ci�Mana ger Approvali SUBJECT: RESOLUTION OF THE SAN RAFAEL CITY COUNCIL WAIVING PAYMENT OF FEES FOR USE PERMIT APPLICATIONS FOR SAN RAFAEL CONGREGATIONS PARTICIPATING IN THE ROTATING EMERGENCY SHELTER TEAM (REST) PROGRAM DURING 2013 RECOMMENDATION: Adopt Resolution approving a waiver of the $ 4,305.00 for San Rafael Congregations participating in the REST Program in 2013. BACKGROUND: The Rotating Emergency Shelter Team ("REST") Program runs from November 15 to April 15 each year. The purpose of the program is to provide temporary winter shelter for people who cannot access the Mills Street Shelter. The program provides shelter for up to 20 women and up to 20 men from November 15 to April 15. The women are housed at the County Wellness Center and meals are provided by Marin congregations. Congregations throughout the County provide shelter for the men one night per week on a rotating basis. Additional congregations participate in the program by providing food for the guests. The program runs from 6pm to 6 am. St. Vincent's provides for the administration of the program and hires the staff that stay overnight in each church. Each participant is screened and approved by the St. Vincent's staff in advance. People cannot drop in or walk up to the church and be admitted for the night. Guests are picked up each night, delivered to the church, picked up in the morning, and transported to 9, St. Vincent's for breakfast. Once guests are admitted to the church for the evening, they cannot leave unless they are accompanied by a REST program staff person. While the program does not provide permanent housing to the estimated 1,12.0 homeless individuals in the County, it has been a successful program. St. Vincent's has stated that the congregant volunteers developed relationships with and respect for those that were seeking shelter and therefore are eager to provide shelter again to their friends as permanent solutions are being worked out. The REST program also includes a Housing Initiative Group where guests can focus on achieving their housing goals. St. Vincent's provides rental deposit assistance for participants in the housing initiative group. FOR CITY CLERK ONLY ZrIllffo Council Meeting.. Disposition: RESOLUTION NO. 13612 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL WAIVING PAYMENT OF FEES FOR USE PERMIT APPLICATIONS FOR SAN RAFAEL CONGREGATIONS PARTICIPATING IN THE ROTATING EMERGENCY SHELTER TEAM (REST) PROGRAM DURING 2013 WHEREAS, The City's Zoning Code requires a conditional use permit for homeless shelters in the majority of the City's zoning districts. The fee for a conditional use permit is $4,305 per application; and WHEREAS, City Council Resolution 11025 (policy for consideration of fee waiver requests for planning and building permits) sets forth procedures for waiving planning application fees from non-profit applicants providing services to low-income persons up to $2,000 and gives the City Council discretion for granting fee waiver requests in excess of the $2,000 Maximum; and WHEREAS, In September 2009, the Vineyard Christian Fellowship Church,, San Rafael United Methodist Church,) First Presbyterian Church, Unitarian Universalist Church of Marin and Christ Presbyterian Church, submitted a letter requesting a fee waiver of all planning fees relating to securing Use Permits to operate an open rotating shelter program for the homeless and the Marin Community Foundation offered to fund all fees in excess of $4,000; and WHEREAS, at its October 5, 2009 meeting the City Council unanimously supported the waiver of planning application fees for use permit applications beyond the $4,000 offer made by the Marin Community Foundation for each application, subject to requests being made to the Foundation by the churches; and WHEREAS, In 2010 and 2011 no San Rafael congregations participated in the REST program and only First Presbyterian Church participated in 2012; and WHEREAS, San Rafael congregations, including First Presbyterian Church, plan to participate in the REST program in future years. Each congregation will be applying for an individual conditional use permit to cover a three year period with an annual report on the program provided to the Planning Commission and City Council, NOW, THEREFORE BE IT RESOLVED that the City Council of San Rafael hereby waives all Use Pen -nit application fees for San Rafael congregations that apply for conditional use permits in 2013 to participate in the REST program; and BE IT FURTHER RESOLVED that this fee waiver is a one-time exception from Resolution 1102.51 for Use Permit planning applications received from San Rafael congregations Zn for 2013.
