SUBJECT: A Resolution of the City of San Rafael authorizing the Public Works Director to accept
the relinquishment of three properties from the State of California in relation to the Puerto Suello Multi -
Use Pathway.
RECOMMENDATION: Staff recommends that the City Council authorize the Public Works Director
to sign CalTrans Relinquishment form letter and take necessary action to incorporate these properties into
the City's roadway system...
BACKGROUND: The Puerto Suello Multi -Use Pathway project was completed by the California
Department of Transportation (CalTrans) in 2010. The project included the installation of a multi -use
pathway from the end of Merrydale Avenue to Mission Avenue. The new pathway parallels Highway
101 and separates cyclists and pedestrians from Lincoln Avenue.
In order to construct this project, the CalTrans utilized several small sections of roadway at the end of
Myrtle Avenue, Grand Avenue and a portion of Linden Lane. Now that the project is completed,
CalTrans is relinquishing these properties to the City.
ANALYSIS: Per Section 73 of the Streets and Highways Code CalTrans is obligated to relinquish right
of way which is not part of the State Highway system. In this case,, these small parcels are extensions of
each city roadway, and abut the state highway system.

WHEREAS, the State of California, Department of Transportation (CalTrans)
completed the construction of the Puerto Suello Multi Use Pathway in 2012; and
WHEREAS, CalTrans has notified the City of San Rafael of their intention to
relinquish associated portions of right of way that are outside the state highway systems
per the requirements of Section 73 of the Streets and Highways Code; and
WHEREAS, the sections of right of way are shown on the drawings labeled "Rel
No 56103 State of California Business, Transportation and Dousing Agency, Department
of Transportation, RELINQUISHMENT in the City of San Rafael, Road 04 -MRN -101 -
PM 11.6/11.9, Road 04 -MRN -101 -PM 18.7/19.2')' a copy of which is attached hereto as
Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Rafael authorizes the Public Works Director to sign the State form accepting the road
right of way into the City Road system.
