RECOMMENDATION: Staff recommends that the City Council: 1. Adopt Resolution; and 2. Authorize the set aside of the additional funds of budget allocation for FY14-15 to cover legal and administrative costs associated with the continued implementation of the program. BACKGROUND: The City's Massage Ordinance was last updated in 2010, which was prompted by changes in State Law and modifications made by the City to achieve better compliance and enforcement. Immediately following adoption of the ordinance, the Police Department, which was assigned to implement and enforce the ordinance, experienced substantial budget and staff reductions. Therefore, from 2010-2013, there was limited implementation and enforcement of the Massage Ordinance. Amongst growing concern from the public and the City Council in the spring of 2013, the Council directed staff to re-initiate the enforcement and implementation of the City's Massage Ordinance. The Police and Community Development Departments worked together to develop various options, ranging from increased, periodic enforcement to full, proactive administrative and criminal enforcement. These options were presented to the City Council andultimately, Community Development Department (Code Enforcement Division) was assigned to take the lead for this program with a focus on the administrative -type enforcement. The Council authorized allocation of $100,000 for a one year pilot program to hire a consultant to implement the ordinance to its fullest and report back near the end of the one year period to evaluate the 1:4ZOU4 0 1 Council Meeting: b C� P is Position program's successes/failures. The following represents some key milestones since the initiation of the pilot program: In August 2013, the City Council authorized a contract with CSG Consultants for a one year pilot program, with a maximum budget of $100,000. Between August and October 2013, staff worked with the consultant to develop th program (framework, tracking software, forms, processes, checklists, and training) �1 In October 2013, a letter was mailed to all existing massage establishments informing them of the re-initiation of the program, requiring that they register with the City within 3 days of the letter, informing them of the operational rules, and notifying them of upcoming inspections. I November 2013 to current, Inspections and enforcement has occurred at over 59 massage establishments in the City. ANALYSIS: Implementation and enforcement of the massage ordinance remains one of the City's top priorities as it relates to continued improvement of our Downtown area and economic development. With reduced staffing levels, in the Police Department and Community Development Department (Code Enforcement Division), the City is not able to take on the comprehensive implementation of the ordinance as currently prescribed. The hiring of a consultant to assist in the implementation and enforcement of the ordinance has been necessary to complete the one year pilot program. One important note is that not there are many law abiding massage establishments, where the business owners and practitioners comply with all state and local laws. The focus of this program has been to inspect all establishments, and focus the enforcement on those that violate the ordinance. It is important to note that it is only a subset of all massage establishments that repeatedly violate state law and local ordinance as well as engage in questionable behavior. Many of the City's establishments are compliant with the ordinance. This past year, the City hired an outside consultant to provide the bulk of the staffing needed to implement the ordinance. The following represents a to -date summary of pilot program: Status of current contract: The current contract has a one year term, ending August 19, 2014 and a maximum budget of $100,000. Through April 30th, $89,237 of the $100,000 budget allocation has been used. It is expected that the remaining $10,763 of the budget will last through May 31, 2014. Key Statisfics: In evaluating the performance of the program these past 9 months, there are a few important notes and some key statistics. 1 The program and the administrative process had to be bu i It -from -scratch. The first 3 months of the program required a significant amount of staff time to develop the program, (ie. creating an inventory of massage businesses and practitioners, developing inspection checklists, application forms, etc., developing tracking methods configuring the permit tracking software to manage the program, and training for contra staff). The contractor helped in this as well, but the majority of this work was performed by staff . I FA 2. The following represents some key statistics on the findings during the one year trial period: Massage Establishments Registered 59 Number of Certified Massage Practitioners employed at the 59 Establishments 170 Number of Inspections Conducted 241 Number of Violations Discovered 258 Number of Citations Issued 82 #of Businesses cited 2 or more times 29 Amount of Citations Issued (thru 5/23) $811125 Amount of Citations Collected (thru 5/23) $727133 Citations appealed 3 # of massage establishments permanently closed 0 # of massage establishments temporarily closed 3 Establishments brought up for Revocation/ Suspension 1 *A revocation hearing to revoke/suspend a license for one establishment is Curren underway. A hearing was held on May 21st and has been continued to June 18'h 1 Successes: The following is a summary of the successes of the program to date: Gained attention of massage establishment. Most massage businesses now know that th(& City is proactive and diligent in inspecting massage establishments to ensure that they follow State law and our local Massage Ordinance. Difficulty in Massage Businesses Trying to Sell. Anecdotally, we have heard that many massage businesses are now trying to sell and are experiencing difficulty in selling given reluctance of new owners to take on a business with the increased scrutiny and enforcement. • Citation revenue. Revenue collected from citations has been an unexpected success. When the program was initiated, citation revenue was not a factor nor initially factored into the pilol program budget to off -set the costs of the contractor; however, to date, citation revenue has covered nearly 72% of the program's costs ($100,000) for the first year. • Pursue Revocation/S uspens ion. To date, we brought a revocation case to revoke/suspend the license of one establishment that demonstrated repeated and serious violations of the ordinance to a hearing. Flexibility in inspections. Bringing on a consultant has allowed the City to inspect at all hours of day or night and on weekends, which we would not have been possible through use of city staff (as City staff has set work hours). Changed practices in some establishments. This focus has resulted in many businesses improving their business practices to achieve compliance with the ordinance (i.e. more proper dress, wearing of ID badges, doors not being locked). Temporarily closed three establishments. Temporary closure (voluntary) has been achieved with three establishments as a cooling off period after repeated violations were discovered. Slowdown of business. We have heard from many different businesses, potential buyers of massage businesses and massage practitioners that the massage business in some of the '1111 VIA, I establishments has slowed down. This has translated to more days/hours closed anli practitioners scared to work. Working Relationship with CAMTC. The City has developed a working relationship with the quasi -state agency California Massage Therapy Council (CAMTC) in charge of registering and permitting the individual massage practitioners and CAMTC. We are communicating our findings and inspection results and hope they will ultimately use that data to pursue their own enforcement actions against the individual practitioners, which the City does not regulate or permit. Slight improvement of appearance. Appearance of some of the establishments has slightly improved I including less open signs, more open windows. I 1111111 11111 r 11111 Mill Management and Staff Time. The City does not have a budgeted Code Enforcement Manager position, so the management of the Code Enforcement, including the new pilot program, has been absorbed by Planning Manager. This addition of responsibility has shifted and reduced the management of Current and Long Range Planning activities. In addition, given the limited budget, the hours that the consultant is here, does not meet the demand of massage businesses coming in with questions, changes to registration, etc. T i consultant cannot keep up with volume of calls, questions, appointments, and this puts impacts on other departments with limited staffing, primarily cashier/ business license staff and planning counter staff. Citation Appeals/Revocation process. The process for citation appeals and revocation hearings are extremely time consuming and divert from the main duties of registering and inspecting massage establishments. Staff has been able to pursue only one potential revocation for a business with repeated and egregious violators during the pilot program (commenced on May 21st and was continued until June 1 8th) . Furthermore, most of the work to prepare the required evidence and staff report has been done by one of the current inspectors (taking them away from inspections) and the Planning Manager (further depleting their already -limited capacity). Safety/Allegations. By using our pilot program budget efficiently (one officer on inspections), there has been an increased exposure to safety concerns for the officer and allegations of improper conduct against the officers. Ability to catch violations. By using one officer for inspections to maximize budget, it limits our ability to discover, identify and adequately photograph violations. Many violations are moving out back doors and clean-up of violations occurs by time officer enters the premises. Many violations are remedied, by time officer gets in back (i.e. dresses pulled down, robes put on, Locked door exclusion. State law and thus our local ordinance allow the front door of a massage esta ilishment to be locked when the business is staffed by one person only. This law has proven to be an advantage to the business operator, even when more than one person/staff is on site. All these businesses have security cameras at their entry doors, which provide an immediate image of the visitor. By time officer enters, if at all, violations are often fixed or removed. Public concern and expectation. The initial public concern was about prostitution, customer traffic at all hours, and number and appearance of these establishments. Once we started the program, most of the public concerns then focused on human trafficking. Human trafficking is a complex issue. It is much more than what Code Enforcement officers have expertise or authority to enforce, and it is much more complex than what a single city can .2ddress. Human trafficking is a regional/international issue and need law enforcement involvement. The District Attorney has recently started a task force on this issue. Pushing activity underground. Our attention to this program has seemed to push activity further away from the stationary business locations to mobile or non -fixed storefronts, thus making it difficult to track and enforce. Transient Business . Massage is a very transient business, and businesses find ways to work around regulations. We require a change in registration every time employees change, which is a frequent occurrence in this industry. The requirement for the businesses to change registration results in constant paperwork and data entry on our part. Lang uage/comm u nication. For many of the business owners and practitioners English is not their primary language so communication is difficult and time consuming. Next Steps: On May 5, 2014, the City Council conducted a study session on the massage ordinance, and to receive a report on the status of the pilot program. Staff reported many of the same facts as presented in this report. At the conclusion of the study session, the Council expressed its intent to continue the program for another year and continue to seek to eliminate all massage establishments the repeatedly violate our ordinance. At that time, the Council asked what it would take to continue this endeavor and address some of these challenges. The following is a summary of the items that would be needed to further implement and enforce the ordinance in a more rigorous fashion for another fiscal year. Additional Contractual Services 1 AdministrativelCounter Technician to deal with the volume of questions, paperwork, questions that come in person or over the phone, data entry for registration, checking state credentials, etc. Furthermore, this would allow for more efficient use of inspectors time by a person at a cheaper billing rate than an inspector. The proposed billing rate for an admin/counter person is $65/hr. and it is anticipated that this person would average 3 days/week at 6 hours day. 2 Lead Code Enforcement OfficerlProgram Manacier to deal with day to day operations. Management in Community Development is already extremely limited. Currently, the Planning Manager has not only manages the complex current and long range planning functions but, for the past two years, has assumed management of the entire Code Enforcement Division. With the addition of managing the massage enforcement program, the ability for the Planning Manager to provide efficient oversight of the Planning and Code Enforcement Divisions has been greatly impacted. Therefore, it is proposed that one of the current contract inspectors be assigned as a lead officer to- a) handle the day-to-day management of the massage program; b) address issues as they surface; and c) serve as a liaison with department management on a weekly basis. Furthermore, with more potential citation appeals and revocation hearings, the Program manager would take the lead in preparing these reports and evidence. This lead officer would also supplement in performing inspections. The proposed billing rate for this contact person would be $92.00 per hour, and it is anticipated that this officer would work two i. "eat eight hours day. 3 Code Enforcement Inspectors to continue to do inspections. Currently, we have two officers who do the inspections, with one of the two, doing most of the paperwork, administrative work, registration, etc. the rate for the officers would continue to be $85/hr. and it is anticipated that we would use 1-3 inspectors a week, for an average of 8-24 hours a week. We would schedule on a weekly basis, with some weeks having low inspection and some weeks with heavy inspections. CSG consultant has prepared a scope of work, with the hourly rates for each of these positions, which is provided in Exhibit B to the Draft Resolution. Safety/Inspection Eguipment During this year, we have identified some concerns for the safety of our contract code enforcement officers as well as their ability to quickly document violations. Inspecting massage is not like typical code enforcement as issues of violation are in flux, and are not stationary (e.g., a fence built without permit, or high -growing weeds or inoperable vehicles). Massage deals with people, their dress and other items that can be corrected in one second. In addition, we have experienced the potential for allegations of improper conduct to be charged against our officers during inspections One solution that we would like to pursue is to outfit our officers with body cameras, similar to those that the Police Department now use. This will go a long way in helping address this issue. There will be a cost to purchase 3 of these cameras and that is included in the other administrative costs that are being requested for this program. It is anticipated to cost less than $3,000 for the three cameras. Associated Costs During this year, we have also found that there are other associated costs to the program, that weren't anticipated, but have been absorbed, resulting in budget overruns in the City Attorney's office budget during the 1 st year pilot program. These include: 1 . Legal assistance to hearing officer. The first hearing officer for a revocation was assigned to a Captain in the Police Department. Although the Captain's time is part of current budget, the existing outside counsel for the Police Department was brought on to advise and assist the Captain in serving as the hearing officer. In addition, a court reporter was required to take a transcript of the proceedings. The costs from the Vt revocation hearing to date are nearly $5,000. 2. Hearing officer for potential appeal to revocation/sus pension. Our Code allows an appeal process if a massage certificate is revoked/suspended by the initial hearing officer. The City would have to use an outside hearing officer, namely the State of California Office of Administrative hearings, an independent hearing body to serve in this function. It is anticipated that if we receive such an appeal, the cost for a hearing officer, including court reporter, would be around $15,000-$20,000 for one appeal of a revocation. Therefore, as part of this program, staff is requesting that an additional $30,000 (aside from the contract with CSG) to cover the associated costs listed above and the purchase of body cameras. Additional Changes to Program or Ordinance In addition to enhancing these contractual code enforcement services, staff has and will continue to pursue: 1 Changes to State legislation to assist cities in addressing the issues of the enforcement of massage establishments. The City Manager recently sent a letter to the State supporting Assembly Bill (AB1 147) which is intended to revise the state laws dealing with massage and return more control to cities. 2. Consider further refinements or changes to our Massage Ordinance to make it more effective and address any loopholes or issues we have faced to date, Once we see the outcome of the current revocation hearing we are prosecuting and following the changes being considered to state law, we will revisit our ordinance to see ways to potentially reduce allowable hours of operation for massage establishment, pursue financial penalties on property owners if a message business violates the ordinance, enatin the locked door loophole (assuming state law changes). i 3. Increasing fines for violations. City staff, led by the Police Department is currently reviewing the current fines schedule, which was last updated in 2004. A comprehensive update will be brought to the Council in summer/fall of 2014 for consideration. Increasin of massage fines is under consideration. I Revised Contract: Based on the discussion above, the 1 st amendment to the Professional Services Agreement with CSG Consultants is presented to the Council for consideration. This amendment would do the following: 1. Increase the term of the current one year contract set to end August 19, 2014 1 September 30, 2015; and 2. Increase the maximum budget of the current, contract from $100,000 to $320,000, an increase of $220,000 to cover continued implementation of the Massage Ordinance for another one year with additional resources as noted above. FISCAL IMPACT: Execution of the First Amendment to the Agreement for Professional Planning Services would result in a significant fiscal impact to the City. However, the Massage Ordinance and the initiation of the massage inspection program has been a priority for the City and the City Council has expressed its intent to continue and increase the program this coming fiscal year. The expenditure for this contract will be administered through the City's Massage Ordinance Implementation Special Fund (31059-07). The program is funded by General Fund allocation through the Council's priority setting. The amendment to the agreement would result in $220,000 that would be set aside for the Massage Ordinance enforcement/implementation for FY 2014-2015 and part of FY2015-16. The contract for the Massage Ordinance services would be within the $250,000 maximum allocation recommended by staff to be set aside by the Council. In addition, the implementation of the program will require an additional set aside of $30,000 General Fund monies to cover other associated costs with the implementation of the Massage Ordinance, namely hearing officer time, court reporter time and purchase of body cameras. The set-aside of the $30,000 money for associated costs, in conjunction with the $220,000 maximum contract cost for contract staff, would be within the $250,000 maximum allocation recommended by staff to be set aside by the Council. It is important to note that during the one year pilot program, $72,000 of citation revenues were collected for violations of the Massage Ordinance. This citation revenue was an unexpected benefit of the increased enforcement and, as a result, reduced the net cost of the 1st year of the program from $100,000 to $28,000. Although we do expect citation revenues in the future through increased enforcement, the amount is not guaranteed and at some point, there may be a diminishing return and the current rates cannot be guaranteed. If establishments close or violations are not found, then citations would not be issued. Staff would recommend that a conservative estimate for citation revenue for the next year to be $70,000. OPTIONS: The following options may be considered by the City Council - 1 Authorize the City Manager to the First Amendment for Professional Code Enforcement Services with CSG Consultants, Inc; or 2. Authorize the City Manager to execute the First Amendment for Professional Code Enforcement Services with CSG Consultants, Inc, with certain modifications; or 3. The Agreement for Professional Services establishes a budget limit of $100,000 and a term limit ending on August 19, 2014; and WHEREAS, as part of the authorization for a one year pilot program, the City Council requested a status report to evaluate whether the program should continue after the one year term; and WHEREAS, on May 5, 2014, the Community Development Department staff presented an update on the one year pilot program at a City Council study session, reporting on the Endings of the program to date, as well as the successes achieved and challenges faced during the one year trial period, and WHEREAS, the maximum budget authority established under the current Agreement for Professional Services is nearly depleted; and WHEREAS, at the conclusion of the May 5, 2014 study session, the City Council directed staff to prepare an amendment to the Professional Services Agreement for consideration by the Council at an upcoming City Council meeting.
