exemption to increase the cap in San Rafael. TAM is not formally requesting that other cities support an
increased cap at this time. TAM staff indicates there has been supportive input from other cities and
towns.
At the end of June, the TAM Board of Directors will review the results of a countywide poll that is being
conducted this month and decide what next steps should be taken. Should the sales tax cap ultimately
be increased through State legislation, TAM plans to conduct a countywide expenditure planning effort.
TAM is a local transportation authority authorized by Public Utilities Code Section 180000 et seq. •`
Public Utilities Code section 180201 a sales tax may be adopted if approved by a majority of the voters
and an expenditure plan has been adopted pursuant to Public Utilities Code Section 180206. TAM staff
has indicated they could develop an expenditure plan over the next year or two. This effort would require
2 plan for the expenditure of the expected revenues approved by the Board of Supervisors and of the City
Councils representing both a majority of the cities in the county and a majority of the population residing
in the incorporated areas of the county (including San Rafael). The expenditure plan would be adopted
prior to the election.
FISCAL IMPACT: No direct fiscal impact.
RECOMMENDED ACTION: Staff recommends that the City Council discuss and provide direction to staff
as to how to proceed.
