RECOMMENDATION. Adopt resolution and authorize the Public Works Director to execute the purchase agreement following Caltrans construction approval. 1112,ACKGROUND: The Non -Motorized Transportation Pilot Program (NTPP), funded through federal transportation legislation in 2005 (SAFETEA-LU), allocated $25 million to four communities nationwide, including Marin County. The pilot program was initiated locally in the summer of 2006 by the Marin County - Department of Public Works. The Puerto Suello Hill Path to Transit Center Connector Project is one of 50 NTPP projects to be implemented in Marin County. The Puerto Suello Hill Path to Transit Center Connector Project will construct a ten foot wide multi -us path and six foot wide pedestrian sidewalk on the west side of Hetherton Street between Mission Avenul I and Fourth Street. Landscaping, pedestrian lighting and accessible curb ramps will also be installed. I in order to increase the safety of the pedestrians and bicyclists as they cross each side street, thl. addition,, operations at each of the three intersections will be modified. The existing traffic signal controllers and cabinets located at these three intersections are outdated and obsolete. In order to provide the proposed operational modifications, upgrades to traffic signal equipment at three intersections (Hetherton St/Mission Ave, Hetheron St/5thAve, Hetherton St/4 th St) is required. Furthermore,, since Sonoma Marin Area Rail Transit (SMART) is scheduled to begin operations in 2016, the new signal equipment must include rail pre-emption capabilities and equipment which will be FOR CITY CLERK ONLY Ffle No.: Coundl Meeting: tL lklisposibion essential for bicycle, pedestrian and vehicular safety as well as overall efficiency of the downtown roadway network when SMART begin operations. Obtaining signal equipment can take a significant amount of time. In addition, purchasing the equipment directly from the manufacture will save the City money by avoiding contractor markups. Having the equipment on hand when the contractor is ready to commence construction will expedite the construction of this project. In order to proceed with this project, we recommend purchasing the signal -related equipment, which the construction contractor will install. The traffic signal equipment must be compatible with the remainder of the City's current traffic control system in order to guarantee that the system will function with the greatest efficiency and with the least amount of technical malfunction. For many years, the City has used the most recent technology to operate and monitor traffic operation, including signal controllers and cabinets. Econolite Control Product, Inc.'s equipment has been used citywide for over 40 years. The company has not only consistently provided efficient and reliable equipment but has also provided the City with fair prices and outstanding customer service. The Department of Public Works has been working closely with SMART staff and has confirmed that the equipment proposed for the Puerto Suello Project will work with the SMART rail system. At this time, the Department of Public Works has submitted all necessary paperwork to the California Department of Transportation (CalTrans) and we anticipate receiving approval to start the construction within the next month. ANALYSIS: The City's traffic signal management system is an Econolite Control Product, Inc. system, which requires that all new equipment be compatible with the system. Econolite Control Product, Inc. is the only source of these products. Accordingly, this purchase would qualify as a "sole source" procurement exempted from the City's bidding requirements pursuant to Municipal Code section 11.50.090. FISCAL IMPACT: The cost of the traffic signal equipment for the three intersections associated with this project is $63,133.89. Construction of the City's Puerto Suello Hill Path to Transit Center Connector project will be funded by $350,000 in allocated federal Non -motorized Transportation Pilot Program (NTPP) funds, $497,000 in yet -to -be allocated NTPP funds, and $600,000 in allocated Safe Routes to Transit funds. The cost of the signal equipment, $63,133.89 is included in the total project budget. OPTIONS: 1. Adopt resolution and authorize the Public Works Director to execute the purchase agreement; or 2. Reject the purchase agreement and direct staff to stop the work on the project. This option will result in the loss of $1,447,000 in grant funds.
