San Pedro Assessment District FY2014-15 Annual Reportc►ry oF4���� Agenda Item No: 4. b Meeting Date: July 21, 2014 SAN RAFAEL CITY COUNCIL AGENDA REPORT Department: Public Works Prepared by: City Manager Approval Director of Public Works File No.: 03.01.180.03 SUBJECT: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL CONFIRMING THE ENGINEER'S ANNUAL LEVY REPORT FOR THE POINT SAN PEDRO ROAD MEDIAN LANDSCAPING ASSESSMENT DISTRICT, THE ASSESSMENT DIAGRAM CONNECTED THEREWITH, AND ORDERING THE LEVY AND COLLECTION OF ASSESSMENTS FOR FISCAL YEAR 2014-2015. RECOMMENDATION: Adopt Resolution BACKGROUND: In accordance with the Landscape and Lighting Act of 1972 the City Council is responsible for confirming the Assessment Diagram and levying the assessment for the next fiscal year for the Point San Pedro Road Median Landscaping Assessment District. Willdan Financial Services are the Engineers of Work and have prepared the Engineer's Annual Report. On July 7, 2014 the City Council adopted Resolution of Intention #13769 to order improvements and levy and collect assessments within the Point San Pedro Road Median Landscaping Assessment District for fiscal year 2014-2015. The Council also set the date for the required Public Hearing for July 21, 2014. The purpose of the Public Hearing is to receive any comments about the Annual Report. FISCAL IMPACT: The Engineer's Annual Report identifies $81.95 as the maximum allowable assessment per Equivalent Benefit Unit (EBU) for fiscal year 2014-2015. The actual proposed assessment rate is $79.48 ($53.48 for debt service and $25.90 for operations and maintenance). It is important to note that the FY 2014-2015 assessment represents a .02 cent decrease over the $79.50 assessment for fiscal year 2013-2014. Additional financial highlights: • Since the inception of the Assessment District, $180,000 has been accrued and is now held on reserve; • $20,000 of that total has been identified for additional plantings; • $10,000 of that total has been identified for community signage; • $79,260 is the estimated amount available for FY 2014-2015 for operations and maintenance (O&M) of the improvements; FOR CITY CLERK ONLY File No.. Council Meeting: w�P Disposition: = o 710/ ' 1 • , < SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 2 • $31,200 of that total has been set aside for an annual maintenance contract with Forster & Kroeger Landscaping. • A portion of the O&M funding is available for potential Marin Municipal Water District cost increases related to the drought and other O&M expenses. OPTIONS: The Council can conduct the Public Hearing and adopt the Resolution as described. ACTION REQUIRED: Staff recommends that the Council adopt the Resolution Confirming Diagram and Assessment and Levying Assessment for Fiscal Year 2014-2015. Enclosure: Resolution RESOLUTION NO. 13780 SUBJECT: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL CONFIRMING THE ENGINEER'S ANNUAL LEVY REPORT FOR THE PT. SAN PEDRO ROAD MEDIAN LANDSCAPING ASSESSMENT DISTRICT, THE ASSESSMENT DIAGRAM CONNECTED THEREWITH, AND ORDERING THE LEVY AND COLLECTION OF ASSESSMENTS FOR FISCAL YEAR 2014-2015. RESOLVED, by the City Council (the "Council") of the City of San Rafael (the "City") as follows: WHEREAS, the City Council pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Part 2, Division 15 of the California Streets and Highways Code, commencing with Section 22500 (the "1972 Act"), did by previous Resolution, initiate proceedings for the annual levy of assessments for the San Rafael Pt. San Pedro Road Median Landscaping Assessment District (the "District") for Fiscal Year 2014-2015 for the special benefits received by properties therein from the improvements related thereto in accordance with the provisions of the California Constitution Article XIIID (the "Constitution"); and, WHEREAS, an Engineer's Report, entitled "City of San Rafael Pt. San Pedro Road Median Landscaping Assessment District, Fiscal Year 2014-2015 Engineer's Annual Levy Report", a copy of which is attached hereto, has been prepared, filed and presented to the City Council in connection with the proposed annual levy of assessments for parcels within the District for Fiscal Year 2014-2015 as required by the 1972 Act and the Constitution; and, WHEREAS, the City Council has duly held a public hearing regarding these matters and the City Council desires to levy and collect the annual assessments against parcels of land within the District for the fiscal year commencing July 1, 2014 and ending June 30, 2015 (Fiscal Year 2014-2015), to pay the costs and expenses determined to be of special benefit to the properties within the District, as described in the Engineer's Report. NOW, THEREFORE IT IS HEREBY RESOLVED that the City Council does hereby confirm the diagram and assessment as set forth in the annual report of the Engineer of Work and does hereby levy the assessment set forth therein for fiscal year 2014-2015.
