RECOMMENDATION: Adopt resolution. BACKGROUND: The Mills-Alquist-Deddeh Act (Senate Bill 325) was enacted by the California Legislature to improve existing public transportation services and encourage regional transportation coordination. Flown as the Transportation Development Act (TDA) of 1971, this law provides for the allocation of funds for projects that are consistent with regional transportation plans. The TDA Article 3 funding source is the Local Transportation Fund (LTF), supported by an allocation of 1/4 cent of general sales taxes collected statewide. TDA is one of the few grants which provides funds for maintenance projects. TDA is managed statewide by Caltrans and regionally by the Transportation Authority of Marin (TAM) which is responsible for authorizing funding to local jurisdictions and ensuring public participation. TAM issued a call for applications on July 17, 2014 with applications due on August 27, 2014. Total available finding is $253,127. The City has three multi -use pathways that have been maintained and repaired by Department of Public Works maintenance staff. More extensive repairs are now required. Using TDA Article 3 funds, the City will remove and repair failed sections of existing asphalt and install slurry seals to preserve and protect the multi -use pathways as follows: Shoreline Park Multi -Use Pathway: The Shoreline Park Multi -Use Pathway is located adjacent to the Canal and Spinnaker Point neighborhoods. It is a popular area to view San Rafael Bay and is frequently used by bicycles, pedestrians and families. Just over a mile of the pathway will be rehabilitated with these grant funds. Bahia Vista Elementary School Multi -Use Pathway: The Bahia Vista Elementary School Multi - Use Pathway is also located adjacent to the Canal and Spinnaker Point neighborhoods. A high volume of bicyclists and pedestrians use this pathway as a primary route to Bahia Vista Elementary School, Home Depot, Target, the Boro Community Center, and a branch of the San Rafael Library. The pathway is approximately 0.4 miles long. The entire length will be rehabilitated with these grant funds. 3. Mahon Creek Multi -Use Pathway: The Mahon Creek Multi -Use Pathway provides a direct connection between the Bret Harte neighborhood, Albert Park, the B Street Community Center, the Bettim Transit Center, the future SMART commuter rail station (operational in 2016), Davidson Middle School, and downtown San Rafael. The pathway is approximately 0.2 miles long. The entire length will be resurfaced. The San Rafael Bicycle and Pedestrian Advisory Committee will review and provide feedback on the application and project. The Department of Public Works submitted an application for this grant and was awarded all available funds in the amount of $253,127. ANALYSIS: The Department of Public Works is diligent in identifying funding opportunities for our community. Identifying new funding sources such as TDA Article 3 shows that our City is actively seeking funds for the rehabilitation of pedestrian and bicycle pathways, as described above. In order to be eligible for these funds, a resolution of local support is required. FISCAL IMPACT: TDA Article 3 firnding guidelines do not require a local match. All project costs will be covered by TDA Article 3 funding. ACTION REQUIRED: Adopt Resolution Enclosures (1) 1. Resolution RESOLUTION NO. 13836 A RESOLUTION OF LOCAL SUPPORT AND A REQUEST FOR METROPOLITAN TRANSPORTATION COMISSION (MTC) APPROVAL FOR THE ALLOCATION OF FY14/15 TRANSPORTATION DEVELOPMENT ACT (TDA) ARTICLE 3 PEDESTRIAN/BICYCLE PROJECT FUNDING. WHEREAS, Article 3 of the Transportation Development Act (TDA), Public Utilities Code (PUC) Section 99200 et seq., authorizes the submission of claims to a regional transportation planning agency for the funding of projects exclusively for the benefit and/or use of pedestrians and bicyclists; and WHEREAS, the Metropolitan Transportation Commission (MTC), as the regional transportation planning agency for the San Francisco Bay region, has adopted MTC Resolution No. 4108, entitled -Transportation Development Act, Article 3, Pedestrian and Bicycle Projects," which delineates procedures and criteria for submission of requests for the allocation of "TDA Article 3" funding; and WHEREAS, MTC Resolution No. 4108 requires that requests for the allocation of TDA Article 3 funding be submitted as part of a single, cotmtywide coordinated claim from each county in the San Francisco Bay region; and WHEREAS, the City of San Rafael desires to submit a request to MTC for the allocation of TDA Article 3 funds to support the projects described in Attachment A to this Resolution, which are for the exclusive benefit and/or use of pedestrians and/or bicyclists. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael declares it is eligible to request an allocation of TDA Article 3 funds pursuant to Section 99234 of the Public Utilities Code; and BE IT FURTHER RESOLVED that there is no pending or threatened litigation that might adversely affect the project described in Attachment A to this resolution, or that might impair the ability of the City of San Rafael to carry out the project; and BE IT FURTHER RESOLVED that the project has been reviewed by the Bicycle and Pedestrian Advisory Committee (BPAC) of City of San Rafael, and BE IT FURTHER RESOLVED that the City of San Rafael attests to the accuracy of and approves the statements in Attachment B to this resolution; and BE IT FURTHER RESOLVED that a certified copy of this resolution and its attachments, and any accompanying supporting materials shall be forwarded to the congestion management agency, countywide transportation planning agency, or county association of governments, as the case may be, of Marin County for submission to MTC as part of the countywide coordinated TDA Article 3 claim. Shoreline Park Multi -Use Pathway: The Shoreline Park Multi -Use Pathway is located adjacent to the Canal and Spinnaker Point neighborhoods. It is a popular gateway with views of San Rafael Bay. A little over a mile of the pathway will be rehabilitated. Pedestrians, bicyclists and farnilies with strollers are frequent users of this pathway. Bahia Vista Elementary School Multi -Use Pathway: The Bahia Vista Elementary School Multi - Use Pathway is also located adjacent to the Canal and Spinnaker Point neighborhoods. A high volume of bicyclists and pedestrians use this pathway. It is a primary route for residents to access Bahia Vista Elementary School, Home Depot, Target, the Boro Community Center, and a branch of the San Rafael Library. The pathway is approximately 0.4 miles long. The entire length will be rehabilitated. Mahon Creek Multi -Use Pathway: The Mahon Creek Multi -Use Pathway is used as a connecting corridor between the Bret Harte Neighborhood, Albert Park, and B Street Community Center, the Bettini Transit Center, the fixture SMART commuter rail station (operational in 2016), Davidson Middle School, and downtown San Rafael. The pathway is approximately 0.2 miles long. The entire length will be resurfaced. The rehabilitation of the multi -use pathways identified for TDA Article 3 funding does not require a local match under TDA guidelines. All costs incurred for this project will be covered under TDA Article 3 funding. File No.: 01.25.07 RESOLUTION NO. 13836 ATTACHMENT B — FINDINGS 1. That the City of San Rafael is not legally impeded from submitting a request to the Metropolitan Transportation Commission for the allocation of Transportation Development Act (TDA) Article 3 fiords, nor is the City of San Rafael legally impeded from undertaking the project described in "Attachment A" of this resolution. 2. That the City of San Rafael has committed adequate staffing resources to complete the project described in Attachment A. 3. A review of the project described in Attachment A has resulted in the consideration of all pertinent matters, including those related to environmental and right-of-way permits and clearances, attendant to the successful completion of the project. 4. Issues attendant to securing environmental and right-of-way permits and clearances for the project described in Attachment A have been reviewed and will be concluded in a manner and on a schedule that will not jeopardize the deadline for the use of the TDA funds being requested. 5. That the project described in Attachment A complies with the requirements of the California Environmental Quality Act (CEQA, Public Resources Code Sections 21000 et seq.). 6. That as portrayed in the budgetary description of the project in Attachment A, the sources of funding other than TDA are assured and adequate for completion of the project(s). 7. That the project described in Attachment A is for capital construction and/or design engineering; and/or for the maintenance of a Class I bikeway which is closed to motorized traffic; and/or for the purposes of restriping Class 11 bicycle lanes; and/or for the development or support of a bicycle safety education program; and/or for the development of a comprehensive bicycle and/or pedestrian facilities plan, and an allocation of TDA Article 3 funding for such a plan has not been received by the Transportation Authority of Marin within the prior five fiscal years. 8. That if the project described in Attachment A is a bicycle project, it has been included in a detailed bicycle circulation element included in an adopted general pian, or included in an adopted comprehensive bikeway plan (such as outlined in Section 2377 of the California Bikeways Act, Streets and Highways Code section 2370 et seq.). 9. That any project described in Attachment A that is a "Class I Bikeway," meets the mandatory minimum safety design criteria published in Chapter 1000 of the California Highway Design Manual, 10. That the project described in Attachment A is ready to commence implementation during the fiscal year of the requested allocation. 11. That the City of San Rafael agrees to maintain, or provide for the maintenance of, the project and facilities described in Attachment A, for the benefit of and use by the public.
