CD Review
Draft Element with PC edits sent to HCD (Sept. 2014)
Compliance letter on Draft Element issued based on
completion of required changes (Nov. 2014)
• Expanded discussion of Public Participation to identify outreach
to all economic segments
• Addition of action to Emergency Shelter Program (H -12d) to
amend Code to limit standards consistent with SBz
• Addition of Policy and Program to address Energy Conservation &
Sustainability (H-Zga)
• Refinements to Programs to clarify and identify specific actions
for implementation (per SB 375)
B 1537 Update
Signed by Governor -September 30, 2014
Cities in Marin County now fall under the "suburban"
designation for the "default density" standard from
MINIMUM 3o du/acre to 20 du/acre
Not applicable within 1/2 -mile radius of SMART
Law will sunset in2023 (RHNA cycle)
Housing Element & Zoning comply with law; City zoning
meets minimum standard of 20 du/ac and no need to do
anything further
B 1537 Update
Opportunity to "dial -back" zoning densities
Don't recommend because:
• Affordable housing difficult to finance/build at lower densities
• Law "sunset" inZo23; next City RHNA could be higher
• Higher densities allowed in zoning districts applied citywide.. .
Downzoning = potential for non-compliant, developed properties
in many neighborhoods
• Need to maintain an adequate buffer/cushion above the RHNA
