RECOMMENDATION: Adopt the resolution_ DISCUSSION: The City recently purchased the property at 1309 Fifth Avenue (APN 011-205-17), located between the Economic Development Building and Fire Station 41. This site is a potential location for a future civic use such as a public safety building. While decisions on municipal project(s) for this site will require more time and planning, staff recommends proceeding with the demolition of the structures on the site and the installation of a temporary parking lot. The 1309 Fifth Avenue property, along with other nearby City -owned parcels, will be analyzed as part of the Essential Facilities Strategic Plan process, which will occur during the first six months of 2015. Regardless of future use, demolition of the existing structures will expedite any future municipal project or projects. This structure is in poor condition. It does not serve any municipal purpose. Since the structure is now vacant, it may attract vagrants or other unwanted trespassing. Trespassing on the site increases the likelihood of a fire and increases the City's potential liability in general. 1309 Fifth Avenue is located between City -owned properties on Fifth Avenue between C and D streets. This property is 7,140 square feet (approximately 50' by 145') and is zoned Fifth/Mission Residential/Office District. It contains a two story wood frame residential building with a basement and a detached garage at the rear of the property. The site is sloped with grade changes between adjacent properties. A categorical exemption has been filed for the demolition of the structure in compliance with the California Environmental Quality Act (CEQA). With Council's approval, staff will proceed with the demolition of the structures which includes, but is not limited to, testing for hazardous materials, obtaining the necessary permits from the Bay Area Air Quality Management District (BAAQMD) and a demolition permit from the San Rafael Community Development Department. Following this Council action, the Department of Public Works will develop a design and a bid package to select a contractor for the demolition of the buildings, grading of the site, and construction of a temporary parking lot. The demolition of this building, now owned by the City, provides a rare opportunity for emergency services personnel to work together in a realistic training exercise. Following demolition clearance for hazardous materials, the Department of Public Works will work closely with the City's Police and Fire Departments to utilize this building for training. The County's Urban Search and Rescue team is also interested in utilizing this building as a training site. FISCAL IMPACT: Funding for the demolition of the structures at 1309 Fifth Avenue and the construction of a temporary parking lot is included in Capital Improvement Fund 9401. Of the $1.3 million available to secure and improve this property for civic use, approximately $800,000 has been spent on the purchase, leaving approximately $500,000 for demolition and parking lot construction. Staff estimates a cost of $300,000-$450,000 for demolition, site grading, and construction of the temporary parking lot. Staff will return to City Council at a future meeting for approval of the demolition and construction contract, OPTIONS: 1 _ Adopt Resolution 2. Do Not Adopt Resolution 3_ Provide Staff with Further Direction ACTION REQUIRED: Adopt resolution authorizing staff to proceed with the demolition of the structures at 1309 Fifth Avenue and direct staff to prepare plans and specifications for the use of 1309 Fifth Avenue as a temporary parking lot. WHEREAS, The City of San Rafael is a municipal corporation which provides services and public infrastructure to residents, businesses, and visitors; and WHEREAS, The City of San Rafael owns numerous properties and buildings which are needed to provide services to the local community; and WHEREAS, the City of San Rafael recently purchased the property located at 1309 Fifth Avenue (Assessor's Parcel Number 011-205-17); and WHEREAS, City Council previously indicated that the reason for the purchase of the 1309 Fifth Avenue site was for municipal purposes; and WHEREAS, there are currently two structures located at 1309 Fifth Avenue: a two story main building and a detached garage; and WHEREAS, the structures at 1309 Fifth Avenue are currently in poor condition and do not serve any municipal purpose; and WHEREAS, the structures at 1309 Fifth Avenue have been reviewed by a qualified architectural historian who determined that they do not meet any of the four criteria to be considered a historic resource under the California Environmental Quality Act (CEQA); and WHEREAS, the demolition of the structures has received a categorical exemption per Section 15303 under the CEQA; and WHEREAS, the City of San Rafael has initiated an Essential Facilities Strategic Plan which may impact the future municipal use of the 1309 site; and WHEREAS, the demolition of the structures at 1309 Fifth Avenue will benefit the health and safety of the community and expedite the future anticipated municipal use of the site; and WHEREAS, the construction of a temporary parking lot at 1309 Fifth Avenue will not limit the options for the future use of the site; and WHEREAS, the temporary use of the 1309 Fifth Avenue site as a parking lot will create more parking supply in this area of downtown. WHEREAS, there are sufficient resources in Capital Improvement Fund #401 for the demolition and for temporary parking lot construction described above. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael does hereby authorize the Public Works Director to proceed with the demolition of structures at 1309 Fifth Avenue and direct staff to prepare plans and specifications for the construction of a temporary parking lot at 1309 Fifth Avenue.
