SUBJECT: A Resolution of the City of San Rafael authorizing the Public Works Director to accept
the relinquishment of three properties from the State of California along East and West Francisco
Boulevard.
RECOMMENDATION: Staff recommends that the City Council authorize the Public Works Director
to sign Caltrans Relinquishment form letter and take necessary action to incorporate these properties into
the City's roadway system.
BACKGROUND: The 5801101 overpass was constructed in 2010. The construction involved widening
the 580 overpass and portions of Highway 101 through San Rafael. At the time of the construction..
Caltrans owned certain portions of Francisco BIvd East and West as well as a section of Rice Street. Now
that the construction for the 5801101 overpass is completed, Caltrans wants to relinquish the right of way
to the City of San Rafael.
ANALYSIS: Per Section 73 of the Streets and Highways Code, Caltrans is obligated to relinquish right-
of-way which is not part of the state highway system. In this case, these small parcels are extensions of
each City roadway, and abut the state highway system.
ACTION REQUIRED:
Adopt the Resolution.

RESOLUTION NO. 13868
A RESOLUTION OF THE CITY OF SAN RAFAEL AUTHORIZING THE PUBLIC
WORKS DIRECTOR TO ACCEPT THE RELINQUISHMENT OF THREE
PROPERTIES FROM THE STATE OF CALIFORNIA ALONG EAST AND WEST
FRANCISCO BOULEVARD.
WHEREAS, the State of California, Department of Transportation (Caltrans)
completed the construction of the 580/101 Overpass in 2010; and
WHEREAS, Caltrans has notified the City of San Rafael of their intention to
relinquish associated portions of right-of-way that are outside the state highway systems
per the requirements of Section 73 of the Streets and Highways Code; and
WHEREAS, the sections of right of way are shown on the drawings labeled "Rel
No 56112 & 56120 State of California Business, Transportation and Housing Agency,
Department of Transportation, RELINQUISHMENT in the City of San Rafael, Road 04-
MRM-101=PM 10.3/10.7, Road 04 -MRM -101 -PM 10.0/10.6, Road 04 -MRN -101 -KP
16.1/17.1" a copy of which is attached hereto as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Rafael authorizes the Public Works Director to sign the State form accepting the road
right-of-way into the City road system.

foregoing resolution was duly and regularly introduced and adopted at a regular meeting
