SUBJECT: CONSIDERATION OF A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN RAFAEL IDENTIFYING THE TERMS AND CONDITIONS FOR
COMPENSATION OF FIRE DEPARTMENT PERSONNEL FOLLOWING A RESPONSE
AWAY FROM THE OFFICIAL DUTY STATION AND ASSIGNMENT TO AN OUT -OF -
COUNTY EMERGENCY INCIDENT.
RECOMMENDATION: Adopt Resolution.
BACKGROUND: The State of California Fire Department (CAL Fire) and the Federal Department of
Forestry depend on local government resources to assist with large-scale wildland incidents. As
California's population continues to expand into wildland areas, urban interface fire activity is expected
to continue to increase in frequency and severity.
Under the auspices of the California Fire Assistance Agreement (CFAA), the State of California and
Federal Fire Agencies may request emergency apparatus and personnel from local government fire
agencies within the California Fire and Rescue Mutual Aid System, and responding local agencies may
receive reimbursement of their response costs through the State Office of Emergency Services (OES). As
a participant in the California Fire and Rescue Mutual Aid System the San Rafael Fire Department
responded to five (5) out of county incidents in FY 14/15. The total reimbursement amount for these
responses was approximately $300,000.
The State has revised the terms of the CFAA for use in the upcoming 2015 fire season, establishing new
guidelines and reimbursement provisions to ensure adequate reimbursement for mutual aid responses.
A requirement of the revised 2015 CFAA is for the elected body of any California fire agency that
participates in out -of -county mutual aid to adopt a resolution that confirms that their personnel are paid
for actual hours worked from time of departure through time returned to the official duty station,
commonly referred to as "portal-to-portal," and that other reimbursement procedures are in accordance
with the 2015 CFAA.
ANALYSIS: The San Rafael Fire Department's participation in the statewide mutual aid system
continues to be imperative to the emergency preparedness of the City of San Rafael for two reasons:

I . It provides San Rafael firefighters with the opportunity to assist in the control of large and
complex fire incidents. This firefighting experience is directly beneficial to the citizens of San
Rafael in the event of significant fire activity occurring in our area.
2. Marin County, including portions of San Rafael, is prone to wildfire. It is likely that at some
point in the future the City will have to rely on the statewide fire mutual aid system for
assistance. In such an eventuality, having extensive working knowledge of the statewide mutual
aid system will help ensure a more seamless regional response.
Adoption of the attached Resolution is necessary for the City to be in compliance with the 2015 CFAA.
COMMUNITY OUTREACH: N/A
FISCAL IMPACT: Passage of the attached Resolution ensures that the City of San Rafael will be fully
reimbursed for out -of -county mutual aid responses.
OPTIONS:
1. Adopt the attached Resolution.
2. Decline to adopt the Resolution as presented. This action will result in the inability of the
City to obtain reimbursement of its costs incurred in connection with out -of -county mutual
aid responses.
ACTION REQUIRED: Adopt the attached Resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
IDENTIFYING THE TERMS AND CONDITIONS FOR COMPENSATION OF
FIRE DEPARTMENT PERSONNEL FOLLOWING A RESPONSE AWAY FROM
THE OFFICIAL DUTY STATION AND ASSIGNMENT TO AN OUT -OF -
COUNTY EMERGENCY INCIDENT.
WHEREAS, the City of San Rafael is a public agency located in the County of Marin in the
State of California, and
WHEREAS, the City of San Rafael desires to provide fair and legal payment to all its employees
for time worked; and
WHEREAS, the City of San Rafael has in its employ Fire Department response personnel
including: Fire Chief, Battalion Chief, Fire Captain, Engineer, Firefighter/Paramedic, Firefighter/EMT,
and Firefighter; and
WHEREAS, the San Rafael Fire Department will compensate its employees portal-to-portal
while in the course of their employment and away from their official duty station and assigned to an
emergency incident, in support of an emergency incident, or pre -positioned for emergency response; and
WHEREAS, the San Rafael Fire Department will compensate its employees overtime in
accordance with their current Memorandum of Understanding while in the course of their employment
and away from their official duty station and assigned to an emergency incident, in support of an
emergency incident, or pre -positioned for emergency response.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael
hereby confirms that:
1. San Rafael Fire Department personnel shall be compensated according to the Memorandum
of Understanding (MOU), Personnel Rules and Regulations, and/or other directive that identifies
personnel compensation in their workplace.
2. In the event a personnel classification does not have an assigned compensation rate, a "Base
Rate" as set forth in an organizational policy, administrative directive or similar document will be used to
compensate such personnel.
3. The City of San Rafael Fire Department will maintain a current salary survey or
acknowledgement of acceptance of the "base rate" on file with the California Governor's Office of
Emergency Services, Fire Rescue Division.
4. San Rafael Fire Department personnel will be compensated (portal to portal) beginning at the
time of dispatch to the return to jurisdiction when equipment and personnel are in service and available
for agency response.
