TOPIC: COMPLETION OF THE 1309 FIFTH AVENUE DEMOLITION AND PARKING
LOT PROJECT
SUBJECT: ACCEPT COMPLETION OF THE 1309 FIFTH AVENUE DEMOLITION AND
PARKING LOT PROJECT, CITY PROJECT NO. 11258, AND AUTHORIZE THE
CITY CLERK TO FILE THE NOTICE OF COMPLETION
RECOMMENDATION: Staff recommends that the City Council accept completion of the project and
authorize the City Clerk to file the Notice of Completion.
BACKGROUND: The City recently purchased the private residence at 1309 Fifth Avenue. This project
removed the existing single family residence and detached garage, all the contents of the residence,
graded the parcel and constructed a temporary parking lot to be utilized by City vehicles until a final
determination for the property is made. A pre -demolition evaluation was preformed which determined
the need for asbestos abatement. This abatement, as well as the disposal of some old chemicals present,
was performed prior to construction.
The project was advertised in accordance with San Rafael's Municipal Code on April 10, 2015, and
sealed bids were publicly opened and read aloud on April 30, 2015, at 2:00 PM. On May 18, 2015, the
City Council adopted a resolution authorizing the Public Works Director to enter into an agreement with
the low bidder, Team Ghilotti, Inc., and construction commenced on June 22, 2015.
The project was completed on July 30, 2015. The following tables summarize the project milestones and

All work was completed within the number of actual working days allowed. Staff recommends
acceptance of the project and recordation of the Notice of Completion.
ANALYSIS: Pursuant to Civil Code Section 3093, the City is required to record a Notice of Completion
upon acceptance of the improvements by the City. This acceptance initiates a time period during which
project subcontractors may file Stop Notices seeking payment from the City out of the funds owed to the
Contractor for the project work.
COMMUNITY OUTREACH: Advance public outreach was performed for the project with the adjacent
neighbors and businesses regarding the restricted parking on Via Sessi during construction. The Public
Works Department worked closely with the adjacent City services regarding the construction
improvements to minimize disruptions to the public services near the facility — Fire Station #51,
Economic Development (Blue House), Parking Services, City Hall and the Police Department.
FISCAL IMPACT: Construction was completed within the originally authorized budget. The total
project cost of $250,300.34, including advertisement and construction, is shown below.

The 1309 Fifth Avenue Demolition and Parking Lot Project utilizes Capitol Project Fund #401. The
project was completed within the City Council originally approved project budget of $255,000.00. The
difference in funds between the actual project costs and the originally approved project budget will be
applied to various other City Owned Property projects.

The project design and preliminary work was completed by Department of Public Works consultant
engineering staff at a cost of $11,853.96. Public Works consultant staff provided additional construction
management for both the asbestos abatement work and the construction contract at a cost of $34,448.16 as
shown in the tables above.
ACTION REQUIRED: Staff recommends that the City Council accept completion of the project and
authorize the City Clerk to file the Notice of Completion.
