Airport SUMMARY: The attached Memorandum of Agreement (MOA) between the Flood Control & County of Marin and the City of San Rafael (City) establishes roles and Building Maintenance responsibilities in support of the Gallinas Watershed Program, authorized by your Board. This MOA specifically outlines the roles and responsibilities of both Capital Projects agencies in support of Watershed Program implementation. Working with the City, we have revised the scope to reflect their contribution amount to $60,000, Certified Unified Program which is less than the $80,000 scope initially planned. Agency (CUPA) Information gathered through this process will be compiled into the draft Gallinas The Gallinas Creek Watershed has two main drainage basins that contain the Communications jurisdictions of both the County and the City. The drainage basin to the north is Maintenance the larger of the two drainages and flows from the Terra Linda ridgeline to its Road Maintenance confluence with the South Fork of Gallinas Creek near McInnis Park. The South County Garage Fork of Gallinas Creek is fed by several small tributaries that originate in the San Rafael Hills and San Pedro Ridge and flow through the communities of San Disability Access Rafael Meadows, Los Ranchitos, and Santa Venetia. Engineering & Survey The City will continue to participate in stakeholder and community meetings. The Stormwater Program Transportation & Traffic Operations Waste Management J4,/3 (3 S— 0 0- funding provided by the city will support two efforts: 1) an Upper Gallinas Creek Flood Control & Restoration Opportunities Study and 2) a Lower Gallinas Creek Levee Needs Water Resources Study. Both efforts are consistent with Program goals. The City and County will collaboratively conduct outreach to the community and provide opportunities for Land Development public feedback on Gallinas Watershed Program products. Community meetings to gather input on the draft Program recommendations will be scheduled this Purchasing winter. Real Estate Information gathered through this process will be compiled into the draft Gallinas Watershed Program Report, which is scheduled to be completed and available Reprographic Services this winter. Road Maintenance Stormwater Program Transportation & Traffic Operations Waste Management J4,/3 (3 S— 0 0- Board of Supervisors May 19, 2015 Page 2 of 2 FISCAL IMPACT: To date, the city of San Rafael has contributed $40,000 to the Gallinas Watershed Program as described in the attached resolution adopted by the San Rafael City Council on November 17, 2014 -The city has been invoiced for the remaining $20,000 which is being provided through a settlement agreement with the San Rafael Airport. The County has already provided $80,000 for this project. There is no budget adjustment needed, as receipt of these funds was budgeted in the Project's work plan. Funds will be deposited in Watershed Stewardship Project Fund 10000, FC 4100995010, Account 4640322 - Contributions. There is no net increase to net County cost as a result of this action. Whereas, the COUNTY Board of Supervisors authorized implementation of the County -wide Watershed Program ("the Watershed Program"), and Whereas, the purpose of the Watershed Program is to provide a framework to integrate flood protection and environmental restoration with public and private partners to protect and enhance watersheds within the County, including the watershed described in the Watershed Program as the "Gallinas Creek Watershed". and Whereas, the Gallinas Creek Watershed includes the jurisdiction of both the CITY and COUNTY, and Whereas, the CITY and COUNTY desire to collaborate to promote the studies to identify concerns, projects, and opportunities within the Gallinas Creek Watershed with specific work plan as described in Attachment A, and Whereas, the COUNTY and CITY agree to enter into a partnership to promote these mutually beneficial goals for the Gallinas Creek Watershed, and Whereas, the COUNTY has allocated $40,000 to fund implementation of the Watershed Program for the purposes set forth in this MOA, and Whereas, the City agrees to contribute $40,000 to fund implementation of the Watershed Program for the purposes set forth in this MOA, and Whereas, the COUNTY and the CITY are entering into this Agreement to meet the goals listed below, Goals A. Develop cost effective solutions to reduce flooding damages that threaten communities, local economies, and public services in the Gallinas Creek Watershed; B. Improve navigational access to lower Gallinas Creek; MOA Gallinas Watershed Program C. Protect, enhance and restore sensitive creek and wetland habitat and water quality in the Gallinas Creek Watershed; D. Identify multi -benefit type projects in the Gallinas Creek Watershed that will improve the County's and City's ability to compete for State and Federal funding; - E. Identify projects in the Gallinas Creek Watershed that are resilient to sea level rise and/or provide additional transitional upland habitat; F. Evaluate the beneficial re -use of dredged material for wetland restoration, levee maintenance and shoreline protection within lower Gallinas and Miller Creeks; G. Reduce ecological impacts of flood maintenance activities. Statement of Agreement Now therefore, it is mutually agreed and understood that, upon signing of this Agreement: A. COUNTY will lead Gallinas Creek Watershed planning through the Countywide Watershed Program staff and funding. B. Subject to the availability of funds, COUNTY will complete hydrologic, geomorphic, hydraulic, and habitat studies as described in Attachment A that will support projects that benefit the multiple watershed goals. C. CITY Council and staff will participate in Policy Advisory, Operations and Finance, and Technical Working Group meetings. D. CITY will provide any existing studies or data related to restoration and/or management of Gallinas Creek. E. County will invoice CITY for $40,000 during FY 14-15 to fund implementation of the watershed studies. F. CITY agrees to submit payment to the County within 90 days of receipt of an invoice from the County. G. COUNTY will provide opportunities for CITY to review and comment on Request for Proposals, draft reports, and grant applications. H. COUNTY and the CITY will collaborate to outreach to the community and provide opportunities to inform the -public of the Gallinas Watershed Program. Binding Effect The terms and provisions of this Agreement shall extend to and be binding upon and inure to the benefit of the heirs, executors, and administrators or to any approved successor, as well as to any assignee -or legal successor to any party to this Agreement. Cit Attorney Ell Attest: CITY CLERK Esther Beirne ATTACHMENT A TO MEMORANDUM OF AGREEMENT BETWEEN THE COUNTY OF MARIN AND CITY OF SAN RAFAEL Subject to the availability of funds, COUNTY will complete hydrologic, geomorphic, hydraulic, and habitat studies that will. support projects that benefit the multiple watershed goals. Specifically, the following issues will have a high priority for study: i. Flood Protection for Properties within the Watershed. The study should investigate flood prone areas in the watershed to determine what physical measures need to be pursued to prevent damage to life and property; in particular, the study should include examining flooding characteristics near Oleander Drive, Caltrans' Weigh Station, Del Ganado Rd, Contempo Marin, and the Redwood Dr. industrial area which are prone to flooding. Other areas within North San Rafael may be added as the study is developed and these new areas are identified. Examination of the existing levee systems should be included in this study. 1. Map all areas designated as a Special Flood Hazard Area by the Federal Emergency Management Agency (FEMA). 2. Map three Sea Level Rise (SLR) scenarios: 12", 36", and 60" projections, under existing conditions and under enhanced conditions from item 5 if identified low areas are raised. 3. Interview PW maintenance staff and summarize issues and potential solutions at Oleander Drive, Caltrans Weigh Station, Del Ganado Rd, Contempo Marin, and the Redwood Dr. industrial area. 4. Interview residents and business owners regarding issues at locations described in item 3. 5. Map localized flooding as identified from interviews (items 3 & 4). 6. Map existing levee system. Identify and map areas with a need and potential for future levee construction (including existing pathways). Elevation data to be extracted from LiDAR. 7. Recommend focused capacity work in areas that have been identified as issues due to FEMA, PW, residents, and under various SLR scenarios. Data from items 3, 4 and 5 to be incorporated into GIS. Proposed Chanqes to Existinq Storm Svstems. The study should prioritize drainage and flood protection improvements in the area and provide estimated costs for the potential projects. Stipulation to the type of improvements such as pump stations or culvert replacements should be identified in the final report. 1. Summarize potential opportunities to restore concrete, channelized reaches of Gallinas Creek, perhaps in phases as structures are updated and/or as they approach the end of their design life. Restoration priorities to be determined in collaboration with City of San Rafael PW staff. 2. Provide rough (order of magnitude) costs for channel restoration measures identified as part of item ii(1) work. Sedimentation Concerns. CITY ;s maintenance crews annually remove approximately 70 tons of material is removed from the concrete ditches on Del Ganado Rd and Freitas Parkway. Most of this material appears to come from the upper watershed's open spaces based on the color and type of material. While it appears that sedimentation from the watershed adds to the situation within the alluvial fan of the creek, the study should examine the sediment aggradation downstream of Highway 101 to confirm this assumption. 1. County DPW will work with Marin Parks and Open Space District to assess status of sediment management on their lands and to evaluate methods for reducing sediment discharge in collaboration with City of San Rafael PW staff. 2. Gallinas Watershed Program will make recommendations for future modeling to address dredge limits and timelines.
