HomeMy WebLinkAboutCC Resolution 12447 (Design Assistance; Kimley-Horn)RESOLUTION NO. 12447 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO AMEND AN AGREEMENT WITH KIMLEY-HORN & ASSOCIATES, INC. TO DESIGN SIGNAL IMPROVEMENTS FOR THE INTERSECTIONS OF FIFTH AVENUE AND LINCOLN AVENUE, AND FIFTH AVENUE AND IRWIN STREET. WHEREAS, the City Council adopted Resolution number 11850 on November 7, 2005 authorizing the Director of Public Works to enter into a professional services agreement with Kimley-Horn & Associates, Inc. to design signal improvements for the intersections of Fifth Avenue and Lincoln Avenue and Fifth Avenue and Irwin Street; and WHEREAS, due to the complexity of the existing conditions of the intersections, additional design work and construction support is necessary to avoid construction delay and cost, and accordingly, the scope of services of the original agreement must be expanded; and WHEREAS, the additional cost of $9,600.00 for the additional design and construction work will be allocated from the City's Miscellaneous Traffic Signal Improvement funds; and WHEREAS, staff received a proposal from Kimley-Horn & Associates, Inc. for professional traffic and civil engineering services for the additional scope of work (Exhibit "A" to the amendment); and WHEREAS, staff has reviewed the proposal and has found it to be complete and within industry standards. /d Ci4 4 NOW, THEREFORE, BE IT RESOLVED that the Council does hereby authorize the Public Works Director to amend an Agreement with Kimley-Horn & Associates, Inc. for professional engineering services in a form approved by the City Attorney for the amount of $9,600.00 as listed in Exhibit "A", and take necessary actions to complete the projects. BEIRNE, City Clerk File No.: 18.01.67 AMENDMENT TO AGREEMENT FOR PROFESSIONAL SERVICES CONTRACT WITH KIA,ILEY-HORN AND ASSOCIATES, INC. TO EXPAND THE SCOPE OF WORK FOR TRAFFIC SIGNAL IMPROVEMENTS ON FIFTH AVENUE AND LINCOLN AVENUE AND FIFTH AVENUE AND IRWIN STREET FOR THE AMOUNT OF $9,600.00. WHEREAS, KIMLEY-HORN AND ASSOCIATES, INC. ("CONTRACTOR'), a Civil and Traffic Engineering Consultant, entered into an Agreement (dated November 7, 2005) with the City of San Rafael ("CITY") for civil and traffic engineering consulting services to design and prepare plans and specifications for Traffic Signal Improvements on Fifth Avenue and Lincoln Avenue and Fifth Avenue and Irwin Street; and WHEREAS, CITY has determined that the need exists to expand the scope of CONTRACTOR's work under the original agreement, in order to provide more detailed design work and construction support; and WHEREAS, CONTRACTOR is willing and able to perform the additional scope of work required by the CITY at an additional cost; and WHEREAS, CONTRACTOR and CITY are agreeable to a revision in the existing agreement to increase the scope of work and perform additional duties; and NOW THEREFORE, CONTRACTOR and CITY agree to amend their Agreement for Professional Services, dated November 7, 2005, as follows: Section 5 of the original agreement is amended to read as follows: "5. COMPENSATION. For the full performance of the services described herein by CONTRACTOR, CITY shall pay CONTRACTOR on a time and materials basis for services rendered in accordance with the rates shown on the current fee schedule as described in Exhibits "A" and "B" attached and incorporated herein. The total payment made for any individual work task will not exceed the amounts shown on the Proposal Budgets, set out in Exhibits "A" and `B"." Section 3 of the original agreement is amended to add the following sentence to the end of the section: "CONTRACTOR also agrees to perform the additional services specified in the letter dated February 26, 2008, Exhibit "B" attached hereto and incorporated herein." All other terms and conditions of the original Agreement not otherwise modified by this Amendment shall remain in full force and effect. San Rafael 51h Street Signal Upgrades Page 2 SCOPE OF SERVICES Kimley-Horn and Associates, Inc. (KHA) will provide additional traffic engineering services for the design of traffic signal upgrades at the following intersections in the City of San Rafael: 1. 5th Street/ Irwin Street 2. 5`h Street/ Lincoln Avenue The additional traffic engineering services are for curb ramps design and safety lighting design that are outside of the original scope of work. These additional services have also raised the overall complexity of design for the project, requiring an additional submittal and City review, as well as increased construction support. Task 1 —REVISED FINAL DRAFT PS&E This task consists of revising the Final PS&E documents for the 5th Street/ Irwin Street & 5`h Street/ Lincoln Avenue Signal Upgrades Project (July 2007) to include curb ramps and safety lighting as well as updating the engineer's opinion of probable costs. As discussed during our 2/8/08 meeting, it is our understanding that the existing safety lights on the utility poles and their power will remain untouched by this project, and the City will arrange their removal in a separate effort. The revised FINAL DRAFT PS&E documents will be submitted to the City electronically. The City's original redline plan mark-ups will be returned to facilitate City review. The design in the revised FINAL DRAFT PS&E documents will be considered to be essentially complete, with only minor editorial comments expected. Deliverables: ■ Electronic submittal of project plans (AutoCAD 2007 format) ■ Electronic submittal of project special provisions (Word 2003 format) ■ Electronic submittal of engineer's opinion of probable costs (Excel 2003 format) Task 2 —FINAL PS&E Based on the City comments on the revised FINAL DRAFT PS&E, KHA will prepare the Final PS&E documents. The final submittal will consist of the following: ■ Final Plans in 24"x36" Standard City of San Rafael format on bond. Plans will be signed and sealed by a State of California, registered civil engineer. Plans will be provided to the City electronically in AutoCAD format. Kimley-Horn & Associates, Inc. Deliverable: ■ One (1) set of 100% PS&Eto the City Task 3 —CONSTRUCTION PHASE SERVICES San Rafael 5'h Street Signal Upgrades Page 3 Under this task, KEA will provide additional construction phase services to the City for the 5th Street/ Irwin Street and 5th Street/ Lincoln Avenue Signal Upgrade project related to the increased complexity of the project. These services will consist of the following: • Answering City questions during the project advertising and bidding stage ■ Preparing up to one bid addenda • Responding the Contractor Request -for -Information (RFIs) ■ Attendance at up to one construction field meeting ■ Preparing up to one contract change order (CCO) KHA will perform these services only with the City's authorization. Utility coordination is assumed to be performed by the City and is not included in this proposal. SCHEDULE KEA is prepared to begin work immediately upon receipt of the notice to proceed (NTP), and we will endeavor to meet your scheduling needs. San Rafael 5'" Street Signal Upgrades Page 4 PROFESSIONAL FEE KHA will provide the services outlined in the above scope of services on a time -and -materials basis with a contract ceiling of $9,600. This amount is distributed as follows among the following tasks: Task Budget Task 1 —REVISED FINAL DRAFT PS&E $5,860 Task 2 —FINAL PS&E $1,240 Task 3 —CONSTRUCTION PHASE SERVICES 1 $2,500 TOTAL $9,600 An estimate of hours and cost for each task is attached to this proposal. This fee includes labor cost, direct expenses, indirect expenses and computer expenses incurred in performing these services. Direct expenses for outside services (e.g., as -built scanning, full-size photocopying, overnight delivery) will be billed at cost plus 15%. Services other than those set forth in the Scope of Services shall constitute additional services. Additional services, such as attendance at meetings other than those included in the Scope of Services, shall be performed only with your authorization, and be billed on a time and materials basis as per the attached rate schedule.
