A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
PROVIDING NOTICE THAT THE CITY IS IN THE PROCESS OF PREPARING AND
ADOPTING GENERAL PLAN 2020, INCLUDING CONSIDERATION OF
MODIFICATION OF THE CITY'S SPHERE OF INFLUENCE/URBAN SERVICE
AREA TO EXCLUDE THE LANDS OF ST. VINCENT'S AND SILVEIRA, AND
DIRECTING STAFF TO NOTIFY ALL APPLICANTS OF SUCH PROCESS
BE IT RESOLVED by the Council of the City of San Rafael as follows:
WHEREAS, in July 1988, the City Council of San Rafael adopted San Rafael
General Plan 2000; and
WHEREAS, General Plan 2000 has served the City well in guiding growth for
the past decade; and
WHEREAS, State law requires periodic review and update of a city's general plan
so that the plan accurately reflects current conditions, goals and policies; and
WHEREAS, on October 18, 1999, the San Rafael City Council reviewed the work
program to complete the update of San Rafael General Plan 2000, and adopted Resolution
No. 10518 which formally initiated the General Plan Update Project and directed that
applicants be notified of the General Plan Update process and its potential to result in
changed policies affecting development applications in process; and
WHEREAS, during the past two and half years the General Plan 2020 Steering
Committee has proceeded with preparing a new General Plan; and
WHEREAS on January 13, 2003,the City Council adopted Resolution No. 11237
directing staff: 1) to prepare an amendment to General Plan 2000 for consideration by the
Planning Commission and City Council a) indicating the City's intention not to annex or
to serve the lands of St. Vincent's and Silveira (SVS) and b) directing that the Marin
County Local Agency Formation Commission (LAFCO) remove the lands of SVS from
the City's Sphere of Influence and Urban Service Area as appropriate; and 2) to direct the
General Plan 2020 Steering Committee to consider such policies in their preparation of
the draft General Plan 2020 consistent with this policy; and
WHEREAS, the City has previously published notice of the Council's
consideration of this Resolution in accordance with the requirements of Government Code
Section 66474.2(b)(2).
OHMNAL
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Rafael
that the Council hereby has initiated the General Plan 2020 Project for the purpose of
effecting a comprehensive review and amendment of the City's General Plan; and
BE IT FURTHER RESOLVED, that the Council intends and directs that the
General Plan reflect the recommendations from the following policy documents: the
Economic Vision and Strategies for the City of San Rafael (1997), the Vision North San
Rafael (1997) and Resolution No.11237; and
BE IT FURTHER RESOLVED, that the Council directs staff to notify project
applicants 1) that the City is currently in the process of developing the General Plan
2020, which could result in changed policies thereby affecting development applications
in process; and 2) that specifically, the City of San Rafael intends to consider modification
of its Sphere of Influence and Urban Service Area to exclude the lands of St. Vincent's
and Silveira; and
BE IT FURTHER RESOLVED, that the Council directs staff to publish notice
of this possible policy change and of all future public hearings regarding consideration of
this possible policy change, in accordance with the provisions of Government Code
section 66474.2.

foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the
Council of said City on the 18th day of February, 2003, by the following vote, to wit:
