HomeMy WebLinkAboutCC Resolution 11149 (Donate Passenger Van)RESOLUTION NO. 11149 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE DONATION OF A SMALL PASSENGER VAN TO THE MARIN ABUSED WOMEN'S SERVICES PROGRAM AND AUTHORIZING THE FIRE CHIEF TO EXECUTE ALL NECESSARY DOCUMENTS RELATED TO SAID DONATION WHEREAS, the Marin Abused Women's Services program ("MAWS" herein) is a non- profit agency which has provided much needed support and assistance services to the abused women and children of Marin County and the City of San Rafael; and, WHEREAS, the San Rafael Fire Department has a long-established relationship with MAWS, including the designation of San Rafael Fire Stations as sanctuaries or "safe houses" for the clients of MAWS; and WHEREAS, the clients of MAWS include women, children and their associated belongings and personal property, all of which must be transported from the fire station "sanctuary" to a MAWS facility; and WHEREAS, MAWS personnel and volunteers who respond to the fire stations in response to those women and children seeking the assistance and support of MAWS, require transportation with sufficient capacity to transport the women, their children and belongings to a MAWS facility; and WHEREAS, the San Rafael Fire Department currently possesses a 1990 Chevrolet, six - passenger van which the department no longer uses on a regular basis and which could be provided to MAWS for use as a client -transportation vehicle; and WHEREAS, MAWS is a non-profit organization which is totally dependant upon donations and grants to support its assistance services to abused women and children of the greater San Rafael community; and, WHEREAS, the donation/sale of this van to MAWS would greatly benefit not only MAWS, but also the general public of the City of San Rafael; WHEREAS, MAWS is ready and willing to accept this van in an "as is" condition, and to release, defend and indemnify the CITY for any liability arising out MAWS' use or operation of the van; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Rafael hereby: 1. Finds that all of the above facts are true and correct; 2. Specifically determines that a valid reason exists to waive the bidding requirement for surplus property pursuant to San Rafael Municipal Code section 2.55.070D in that MAWS is a local non-profit service agency serving the community by providing support and assistance to the abused women and children of San Rafael; 3. Hereby sells to MAWS a 6 passenger Chevy van, for the total sum of $1.00; 4. Directs the Fire Chief to execute any and all documents necessary to effectuate the sale of this vehicle to MAWS. I, Jeanne M. Leoncini, Clerk of the City of San Rafael, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted at a regular meeting of the San Rafael City Council held on the 5"' day of August, 2002, by the following vote to wit: AYES: Councilmembers: Cohen, Heller, Miller, Phillips and Mayor Boro NOES: Councilmembers: None ABSENT: Councilmembers: None JE M.
